Re: Being stopped by LEO
I realize one was written before the other. I also don't think it was intended to create a higher standard.
I'm not trying to be argumentative. What has changed since this post?

Actually they are not. If you have a CHL and a gun on or about your person, then you are considered carrying and are required to present your CHL when asked for ID.

Re: Being stopped by LEO
Sorry, I just went by what you typed. Next time I'll just listen to what you are thinking instead. I tried to be as civil and diplomatic as possible. The way you said it came across as advice and in my opinion it is bad advice.
It is still my opinion a person is required, by law, to give the officer his chl when he is carrying and the officer asks for IDI also do not believe the officer has to specifically ask for the chl.
I also think having the chl establishes a higher standard for the chl holder than it does for the person that is just carrying in their car under MPA. I don't agree with it, but I believe that is the way the law is written. I also don't want to be the one that has to pay to clear it up.
Why is it people cannot disagree without someone getting their feeling hurt or offended. I'm going to ignore your personal attacks regarding my reading or comprehension skills. Not going to go there.

Re: Being stopped by LEO
captain, here is your comment in response to someone that said they showed their chl along with their ID.
I think this is bad advice and hope you don't teach the same to your students. You don't have to show CHL. The LEO should already know you have CHL. Only if he asks for it specifically.....for which he should have some valid reason.

Re: Being stopped by LEO
Just because there isn't a penalty doesn't mean the law doesn't require it.

Re: Being stopped by LEO
captain, I suggest you do a search on the forum and or contact Charles Cotton or Keith B regarding this. They are highly informed on this and many other related subjects. I especially encourage you to do it if you are or plan to be an instructor.

I'll go first. Texas Government Code 411.205.
Interestingly, he cited the same code. He just has a different interpretation. One that I think just may cause him some headache should the right occasion arise.

Re: Being stopped by LEO
There are officers on this forum that say they "do not" have that information. I also don't know how the officer can know if the person the vehicle is registered to is the one driving.
They do not have to specifically ask for the chl license. They just need to ask for identification. You are supposed to give it if you are carrying a gun at the time or have one within reach while in your vehicle.

Re: Being stopped by LEO
Can you cite the source that says the officer already knows, one doesn't have to show chl and that he must ask for is specifically. In other words, pretty much all of it except the part regarding it being legal to carry in car concealed.

Remember, you can carry a concealed handgun in your vehicle in Texas without CHL.edgar0400 wrote:Hey guys on a side note I want to comment on Arlington leo.
I got stopped on Thursday by leo because my inspection was expired. He asked for Id so I showed my DL and CHL and he was really cool about it. Didn't make a big deal about my carrying he only asked where it was and nothing else. This was my first time being stopped by Leo. I have to say it wasn't a bad experience at all.
