Still on the table, rekieta law is covering it now. Apparently theres a difference on whether or not the mistrial with prejudice is appealable if its ruled on before or after the jury has reached a verdict.C-dub wrote: ↑Tue Nov 16, 2021 11:23 pm Remember back when there was this thought about the prosecutor intentionally going for a mistrial? The result of that could've been a mistrial with prejudice that would prevent any retrial due to double jeopardy because of intentionally throwing this one. I gotta say that this also smacks of being intentional, but with the hopes of being discovered after the jury has begun deliberation to avoid that mistrial with prejudice thing. Unless that is still on the table?

Im just getting to finishing todays recording of the trial. I dont recall the photographers name but man, he handled the states cross examination pretty well despite the state really trying to get him to falter.

Re: Kenosha Wisconsin Shooter discussion
This definitely backfired for the prosecution. The photo of Gaige pulling his gun from his waistband“30+ ft” behind Kyle proves he was armed and “chasing” him, then the photo that clearly shows Gaige pointing a gun at Kyle, by his own adminission, within 3 ft of him, before Kyle fired. Ouch. The defense is well prepared for this cross.G.A. Then it goes downhill for the prosecution from there. Looks like the witness may have just scuttled his civil lawsuit too during the defense cross-examination.

Legal arguments aside, I agree with this. No matter what the courts decide the age old saying applies, just because you can, doesnt mean you should.mrvmax wrote: ↑Fri Aug 28, 2020 5:19 pm From what I read he was 17 years old parading around with a rifle when he should have been at home. He had no business being there with a rifle trying to act like an adult. This is the real world not a video game and he made a bad decision that may change his life.
I'm not even going to debate if it was self defense or not, if you go looking for trouble you'll probably find it. It what I read was incorrect and he was 18 or older I'll adjust my viewpoint. If not he should have been at home in Illinois.
Plain and simple, he put himself in this situation. It took three to tango here, 2 people lost their lives and a 3rd is in limbo, just senseless.
