You're right, the video shows no one in line. I guess I was going by the original question of "You are in line at Wal-Mart and this happens."

If I was a lot closer to this BG who is crazy enough to rob the store with people waiting in line, my odds of drawing would go up dramatically. The part in §9.33 about "reasonably believes that his intervention is immediately necessary to protect the third person" would have been satisfied, as far as I'm concerned.

Remember that CHL shooting in Oklahoma that we talked about a couple of weeks ago? That shooting was just like this one where the CHL was in line and 2 robbers came in and one stuck a gun to the head of the clerk. He snuck out his gun and shot them. He faces no charges for doing that. Same thing goes here in Texas:
