If you remember where that sign is, I can try to get them a new sign. It is the old version of the off-premises consumption sign. The local auditor or agent checking the place probably did not pay too close attention to it since it was basically the right sign, if the wrong wording.

Unfortunately, this is one option that is not open to me. I think (and it is just that, a personal opinion) that the average police officer is going to go with what signs are posted. If the place is posted, and you are caught carrying in it, you will probably be arrested. If the posting was wrong, you have a great defense but it is still going to cost you. And, if the place is not posted, i bet the average officer will not arrest you even if it was a straight old beer joint bar that had 100% of its money come from on-premises sales.

One of the signs is wrong. Check the license to be sure which one. Either way, call TABC and let the agent in the local office know which location so they can get the correct signs posted.

Again, the important part is what the TABC has determined on the sales. There are now package stores that sell for on premises consumption also (wine-only package stores may do this) and have legal 51 signs.
Ask to see the actual TABC license and look for the "Sign=Red" line. This is what will confirm to you that the premises is off limits according to TABC. If he does not have this line on the license (it will instead read "Sign=Blue"), then you can carry and notify TABC that he has the wrong signs.
