My initial reaction was the same as yours but then I thought about it a bit. What "criminal mischief" was he doing 100 yards down the street? He wasn't shot at the time of the reported violation but down the road attempting to flee. If he was still anywhere near the truck, even if fleeing, I would agree but 100 yards away? Then it's shooting someone for committing a misdemeanor. Fleeing criminal mischief or destruction of property perpetrators usually dont fall into the deadly force statutes !
