Bear in mind that 30.06 notice can also be given orally or via a written handout, so students and faculty might still be subject to arrest, even if there are no posted signs.TrueFlog wrote:I don't see anything in the bill that requires a private institution to post 30.06 when they opt out. However, the bill does state that 30.06 must be posted in order for concealed carry to constitute a crime. [Section 46.035 (a-2)] I would infer that if a private institution opts-out and posts 30.06, then anyone carrying concealed would be subject to arrest as well as discipline by the school (eg. expulsion). If the private institution opts-out but does not post 30.06, then an individual would still be subject to discipline by the school, but could not be charged with a crime.terryg wrote:It looks like even though private institutions can opt out, that they will now be forced to post 30.06 signs. Am I wrong?

Neither--it would be a violation of 46.035(a-3), a Class A misdemeanor.CJD wrote:You are right. I saw a post where Charles said it was decriminalized, but I must have misunderstood what he meant. So would a violation be an offense under 30.06 or 46.03? Big difference.Bladed wrote:I'm not sure what you mean about decriminalization versus preemption of "rules and regulations." Re: Campus Carry -- Where Are We Now?
There are three days at the end of the session when all they're allowed to do is reconcile differences between House and Senate versions of bills and make corrections.CJD wrote:I think they will go for it earlier in case it needs a conference committee.safety1 wrote:Bladed, isn't a day set aside for just concurrence votes? I'd be leaning towards that day. I guess we will see.Bladed wrote:The concurrence vote won't be scheduled the way a vote on a bill is. The bill will become eligible 24 hours after the report was issued. After that, the vote could happen any time.safety1 wrote:Amen!bauerdj wrote:When can we expect a vote on concurrence? I no longer have much interest in who is responsible for the delays etc. My interest for the immediate time period is directed at the status of the different bills that are still alive (especially OC and Campus Carry). After the sessions are over there will be plenty of time who did what on 2A items and react appropriatley.
SB11 should be heard on the House floor tomorrow.
HB910 concurrence vote is thought to be mid week. Not yet scheduled
In the House, the 137th day is the last day to concur (unless a conference committee has been requested and then discharged). In the Senate, the 139th day is the last day to concur. As Charles said, those days aren't officially set aside for concurring, but concurrence votes and action on conference committee reports are basically all they're doing those days.

Re: Campus Carry -- Where Are We Now?
If there is a technical error with the bill (e.g., referring to a statute by the wrong section number) or if it violates a constitutional rule (e.g., the single-subject rule), the Speaker could sustain a point of order. I'm sure both sides are currently going over it with a fine-toothed comb.v7a wrote:Can a POO be called in the House on something the Senate did with regards to SB11? Or can a POO only be called on whatever procedural actions (i.e. how it was considered in committee) have been taken so far on SB11 in the House?
If the former, I hope the Senate is going over everything to double-check there are no procedural errors with SB11 (and fixes any issues found before Tuesday).

Texas legislators can't filibuster a concurrence vote. Please don't spread misinformation.safety1 wrote:This is good, but it must pass clean or it will have to go back to the senate, where it will die via filibuster or otherwise.

Re: Campus Carry -- Where Are We Now?
Corruption isn't nearly as prevalent as are baseless conspiracy theories about corruption. In this scenario, there is absolutely nothing to be gained by offering to pay off a legislator. Numerous legislators, including Trey Martinez Fischer--the master of points of order--are against this bill and will do everything in their power to stop it. What would Bloomberg gain by bribing someone (at the risk of a felony conviction and prison time for both the briber and the bribee) to do the exact same thing?Xikar wrote:Bladed wrote: Nobody is being paid off. Campus carry has enough opponents who will gladly and freely throw up procedural challenges, without the need for anyone to risk an ethics violation.
Don't be so naive. Corruption is alive and well in government. It happens. It's hard to prove if somebody brings up formal charges especially if it's some politicians acting in the best interest of the liberal media who will not cover it.

What I fear now is clerical error sabotage and certain representatives paid off by bloomberg to stall for time with amendments, procedural gimmicks and other legislative tactics.
