There is another possibility. When a new business applies for a license and has no sales history, the TABC takes the owners projected sales to determine 51% or BLUE. Even if the estimate is wrong, the place stays 51% until renewal time, and then actual sales history can be evaluated.

Regardless, many owners do not understand the law and post the wrong (or both) signs. You should look up their license on the TABC app and report them if they are not in compliance.
