If she were in her own apartment with the same outcome, would they have gone down that road? She had no legal requirement to retreat or call for back up, 911 for us, did she? Would a prosecutor attempt to put that requirement on us?

These are the things that bother me about this trial and the prosecutor's tactics.
That does not worry me because the could haves don't apply when defending ones own home. It was not her home. Thinking it is doesn't cut it and should not be OK. Her actions were in no way analogous to a person exercising their rights under the castle doctrine. Not even close.

Let's be real here. She walked into someone elses home and killed them. End of story. That is and always should be punishable by time in jail at the least. Put yourself in his place rather than hers.

Re: Officer Invades Apartment, Shoots Resident

I wonder about a TX Ranger who would go to the wrong apartment on three separate occasions. Also, how many of the 93 residents who have gone to the wrong apartment were either impaired by a drug or just had their head stuck in their phone and who’s SA was 0. The poll was not scientific in the least.

Re: Officer Invades Apartment, Shoots Resident

In the clip I saw of the reading of the verdict, it is clearly the judge saying “ no outburst”.

I no longer trust the investigation. Smells like a coverup is ongoing.

Re: Officer Invades Apartment, Shoots Resident

I heard on an Austin radio news broadcast that the victim’s family says that the DPD are now claiming there was a search warrant which had been issued at the time of the shooting. They also claim DPD are trying to smear the Vic’s name with marajuna allegations. This is beginning to smell.

Re: Officer Invades Apartment, Shoots Resident

I think that with her actions she could be charged under the murder statute. Murder could be considered an over charge as intent is a defense. However, she obviously committed an act that could justifiby carry a murder charge.

This responsibility should come with a higher standard of acceptable behavior than we have for the citizenry as a whole. We don't yet know all the facts here. But I do know that this officer should be held to at least the same standard that would apply if I (a non-LEO) did the same thing she did.

Assuming that the LEO's story is true, that means I would be out on bond right now if I mistakenly enter a LEO's home and then proceed to shoot and kill them. I honestly could see that happening (assuming the bond here is very high, of course). Also, from what I understand of the law, manslaughter is the correct charge absent proof of intent. But obviously we also need the myriad add-on charges including UCW since she was carrying a weapon while committing a felony, etc. I would expect that this LEO will be in another line of work after serving her prison sentence, and also will never be able to legally own a firearm in the future.
No proof of prior intent. She obviously intended to shoot him.

The young man who was shot is black. Don't know about the police officer.
Article says she is Caucasian.
Sorry, must have been another article concerning the shooting.

It is a shame that the race the Officer and the victim are made mention of as though it makes the tradegy worse. It is tragic no matter what the race of each is.

Agreed. Expecting more to the story.
Depends on the apartment. If it is a long line of 30 identical buildings, then maybe... maybe it was an innocent mistake. If it is the typical quadplex or octaplex, I'm not really sure how you do that unless you are drunk.

Here is the street view of the building next door. Depending on how it looks inside, (IE bland hotel everything-is-the-same), I could see how it happens.

Locking your doors is a dang good idea.

I use to frame apartments, condos and etc. They are usually identical or mirrored floor plans per building. However, your belongings (furniture) should be unique unless they come furnished. I wonder it he was a boyfriend or ex boyfriend.
