NO you will have to go to the county clerk and get a disposition, but the way you described your disposition you plead no contest and were given deferred adjudication and are ineligible to have a chl for life. sorry guitardood, but your done

BTW, I don't know how much it would cost, but I would suggest that he get his record expunged.puma guy wrote:Good news, guitargod0687. I did get my license back. I faxed my copy of the Court Dismissal, signed by the county clerk and judge, to the CHL office in Austin. About a month later I received a letter saying there was no longer any legal grounds for a suspension.

This is a weird looking and sounding "word".mojo84 wrote:Is "expuncted" a proper legal term?
My research shows that if the court approves an Order of Expunction then the record is expunged.

I believe everyone should be very careful when carrying a firearm.mojo84 wrote:Captain Matt wrote:Agreed. He can't say 100% it is DA but neither can you say 100% it isn't. The disposition document is the only way to know.Keith B wrote:OK, while you may be correct, until the OP comes back and says what the disposition is you can't 100% say that they got a deferred adjudication. So at this point let's wait until he comes back with the answer to confirm it.
However, until the OP knows for sure, I think he should be very careful about carrying a firearm.

The DA's office and the court are not in the business of providing copies of legal documents.Keith B wrote:Not sure about receiving a copy in the mail. I would suggest contacting the Prosecuting Attorney's office or county court where the charges were submitted and see if they can provide you a certified copy of the disposition.guitargod0687 wrote:I should be recieving a copy in the mail, right? IANAL, but don't believe that the disposition is final until it is filed and recorded by the county clerk.
When the document is recorded the county clerk will send a copy to the OP's lawyer.
It is the same document that the OP would get from the county office.
The OP may need some advice from his attorney interpreting the disposition.
