Re: CARRY QUESTION
IANAL but i'd say just the fence because that's where it's located.Interblog wrote:Attached is an Imgur link to a blurry pic of an easement in the Clear Lake area. The bright white object just left of photo center is a pipeline access point (where the pipeline segment extends above ground, has valves, flanges, etc.). It is surrounded by a chain link fence. Not visible on this photo, but clearly visible in person, are conforming 30.06/07 signs on the chain link fence.Liberty wrote:... I doubt if the easement or utility right of way is posted 30.06/07 anyway. ...
Question: Is the owner and/or easement holder attempting to convey restriction just inside the chain link fence, or inside the entire easement? There are no other structures or points where such signs could be posted if the intent was to declare for the easement itself.

Re: CARRY QUESTION
I was thinking the same thing! They can't keep you from carrying a firearm in your car. that's like them telling you you cant keep a gun in your house... watch me!Soccerdad1995 wrote:If you are ever looking to get a new job, you may want to casually mention to your employer that you have a gun in your car, in their parking lot. Re: CARRY QUESTION
or just conceal it and not worry about it... i think people are digging way too deep into this topic... unless you work at the exceptions listed in the penal code, just conceal your gun and leave it in your car. Don't tell anyone it's there. just leave it and go about your day.gtolbert09 wrote:One thing to keep in mind. Re: CARRY QUESTION
iirc OP mentioned private property not a military base. going back to the topic, MPA trumps some guy who says "no guns on my land, ya hear!" military bases are govt property so i assume govt law would trump texas law at that point. but "tresspassing is tresspassing" as you mentioned earlier, is incorrect because you wouldn't be trespassing on your own property. (also if the AR-15 isnt concealed then you wouldnt be in compliance with the MPA anyway.)spectre wrote:OK. A castle doctrine, also known as a castle law or a defense of habitation law, is a legal doctrine that designates a person's abode or any legally occupied place – e.g., a vehicle or home – as a place in which that person has protections and immunities permitting one, in certain circumstances, to use force (up to and including deadly force) to defend oneself against an intruder, free from legal prosecution for the consequences of the force used.[1] The term is most commonly used in the United States, though many other countries[which?] invoke comparable principles in their laws.

That's what I thought. I thought maybe spectre knew something I didn't. :PScottDLS wrote:Not true. That it covers MPA.spectre wrote:A land owner can give oral notice or written notice. Oral notice prohibiting firearms covers both MPA and LTC.
No, it IS correct because 30.06 only applies to carrying under the authority of your LTC. So if a parking lot is posted 30.06 and you are carrying in your vehicle then you are not violating 30.06. If 30.05 is purportedly used, then you are excepted due to having, not carrying under, LTC, so 30.05 doesn't work either.Grundy1133 wrote:I didn't think you could prohibit someone from carrying in their car per the MPA... Is that incorrect?
For the employer parking lot law, the employer (utility) may not fire you (legally) for parking in their lot....that they own. However if you are parking in another employer's lot and they find out, they can presumably tell your employer you are no longer allowed to work on the property. However depending on the easements, they may not be able to use 30.05 to criminally prosecute you for doing so.
Short answer, leave it in the truck and don't worry about it.
