You're missing my point--the trespasser was no longer an immediate threat to the home or residents as the writeups indicate he had left the back door and was in the side yard. The shooting has certain similarities to the Joe Horn issue (IIRC the name right) where the man observed a burglary next door, called the cops (who did not arrive until after), then exited the relative safety of his home & shot the burglar.

Well I hope he is no-billed, or not even charged, but I am guessing it will go to a GJ at the least. He left a place of relative safety, after police were notified, and confronted an individual who was not presenting a threat to him prior to the homeowner exiting the house.

Yeah, but he is also not presenting an imminent danger either. And unless the homeowner shot thru an exterior wall or window, he had to LEAVE the relative safety of his home to confront & shoot the trespasser.

I have a feeling the homeowner will face charges, if the guy really was standing in the side yard, and not actively trying to get 'in' the home.
