Naw, he doesn't say that. He says "...pushed by the coach's husband, and no assault charges have been filed but it will be interesting to hear if his lawyers try to use that in his defense." From one of the earliest reports, that is not archived, they (KAMC) clearly said no charges have been filed on the husband. This may have changed since these reports were made but I haven't heard or read different.

Still looking and waiting for more details. Any talk, information, etc. has simply stopped around here. Even the I-heard-it-from-a-friend-of-a-friend rumors have dried up.
You're right. I thought I heard "and now assault charges..." This is why I prefer print to video.

I believe the assault charge is a felony so it's possible that the charges will be pled down to a disorderly. Or the DA can decide to charge with a lesser offense in the interest of justice. A disorderly can be used for brandishing a firearm. That's (a)(8) of 46.01.

IANAL, but my reading of 42.01 says it can be illegal:

§ 42.01. DISORDERLY CONDUCT. (a) A person commits an offense if he intentionally or knowingly:
(1) uses abusive, indecent, profane, or vulgar language in a public place, and the language by its very utterance tends to incite an immediate breach of the peace;

It seems to me that if Burke had been using vulgar language he could be in trouble under this statute. And that would have cost him his CHL. So even if Burke hadn't pulled his gun and the husband shoved him, then Burke may still gone to jail along with the husband.

IMHO, the husband should have remembered rule 23 and politely asked Burke to please refrain from his current actions. That is part of being a mature adult. If he didn't stop and as long as Burke was not being physical, call the police and let them deal with it. They are better trained and equipped to deal with the jerks of the world. I firmly believe that is what I would have done.

In this situation at least one of them (and most likely both) forgot rule 23:

My opinion: There is not enough information for a judgement. We need to wait for all the facts. There are quite a few things we don't yet know such as:

Was there a significant disparity in size between the two men?

Does Burke have a physical problem that would not allow him to defend himself the way others can? I notice they ask about drugs and alcohol, but don't ask about mitigating circumstances.

Was Burke's confrontation with the coach justified? (i.e. was the coach doing something to put his child at risk - I have seen coaches that have no business coaching because they don't understand safety first). And was the husband out of line?

What occurred between the push and pulling the gun? The article states that Burke was pushed and then Burked pulled a gun? Could there be selective editing here (no I don't trust the press to report anything accurately).

I'm not defending Burke's actions and if he is in the wrong, then let him rot in jail. However, I won't judge without all the facts.
