Improper evasive maneuver resulting in a collision was one of the exceptions he told me about.

I have a buddy who spent years as an insurance claims adjuster for State Farm. . . this is one of the biggest misconceptions he always tries to dispel. There are several instances where the vehicle that rear ends the other is not at fault. For instance, you can't cut somebody off, slam on the brakes, let them rear end you, and think it's going to be their fault. If I am not mistaken, in Texas a rear-end collision, no matter what the reason, is always the fault of the rear-ender (No laughing here).
You are correct. If you rear end someone, it is your fault, as you are supposed to leave ample distance and time between the vehicles to safely stop.
If someone is literally _on my bumper_, as this officer obviously was, and I was in my company truck... I might feel inclined to brake check them....

I have a dent back there, and could use a new bumper or rear end![]()
On topic to OP: Glad you called and talked to his supervisor. Hope he actually does something about it.
