Yes, anyone can get a new photo at anytime. You have to mail in a CHL-70, CHL-6, new passport photos & check for $25. You should hand write on CHL-70 that you are wanting to just update photo only.

I know for a fact that student's do not need to mail in photos. But, and this is a big but.. they must still send in a CHL-6 form and they must hand write on the form to please use their Texas DL photo. If they fail to write this or if they send in a bad photo, then yes they will get rejected.
To sum up- If they wish to have DPS use their Texas DL photo, they need to hand write this on the CHL-6 form, AND they should not send in any photos. I personally know some people that have emailed their new application documents this way and were acceptable. They did not need to mail DPS anything at all.
To take things a step further, you may even have the students type up a letter in large font stating "Please use my Texas DL photo" and include that along with the other paperwork just as an added bonus.
