Before he got out of the car, it was a reasonably low-key approach by the police. Not in their minds, of course, because they suspected they were dealing with criminals. But the dealer could have easily thought they were in conversation mode, not "freeze, suckah!" mode. If that was his mindset, he might have thought it was perfectly reasonable to step out and explain what was going on. After all, he knew he wasn't doing anything wrong, so he probably thought he could just explain what they were doing and everything would be okay.

I think he just got his first understanding of why we recommend treating even a minor traffic stop as if the cop suspects you're armed and dangerous and wanted for murder.

And those concepts of his that aren't still in use, are the most sorely missed.

The initial takedown was definitely over the line, although some skillful report writing might have gotten the officer off the hook if what he claimed he heard varied from what we heard on the tape. Maybe, not definitely.

The second claim (being physically intimidated from filing an open records request) is actually far more serious, but there's no evidence to back it up.

If you are ever in a situation where you want to file a complaint against an officer, the first step should be a request for any and all records in all formats, written, or electronic, relating to the incident, with a specific time and place mentioned.

After you have that information in hand, you can pursue either administrative complaints, a lawsuit, or even criminal complaints.
