I think anything that is introduced into evidence stands a good chance of becoming public, even if it's not supposed to.
Alzheimer's disease is a terrible thing and not a joking matter at all, but now this man's neighbors know that he is not playing with a full deck.

Re: Friendswood: Man arrested for pulling gun on trespassers
The man was no-billed "for medical reasons":

[The defendant’s] case on June 22 went before a grand jury, which declined to charge the man with aggravated assault with a firearm for medical reasons, Ted Weems, misdemeanor division chief with the Galveston County District Attorney’s Office, said.
[The defendant] said he has Alzheimer’s disease. A doctor submitted a letter to the grand jury detailing [the defendant’s] condition, he said.

Re: Friendswood: Man arrested for pulling gun on trespassers
I don't know. What was curious about was how many other cars or news vans were parked in the area and had anyone else tried to park in his driveway.
I would bet lunch that there were government officials and media people parking all over with no regard for privacy or private property rights, as has already been said. They always do. It's very irritating, but it probably is not a justification for - Jim

Re: Friendswood: Man arrested for pulling gun on trespassers
One day.Did the article say how long after the plane crash that this press conference took place?
I can't help being preachy for a minute. Last week, I went out on my back porch and saw a vehicle parked across the apron of my garage. Apparently my garage is invisible, because people do this all the time. I walked to where I could see the vehicle clearly. A man was sitting in the driver seat fiddling with some papers. I waved at him. He saw me and waved back, then left.
That's all it took.

The time frame for leaving when you get oral notice is however long it takes the cops to get there.boomerang wrote:Isn't it the same time requirement as 30.06?

Re: Friendswood: Man arrested for pulling gun on trespassers
If in fact they parked on private property.
Here's another story: http://abclocal.go.com/ktrk/story?secti ... id=7420183" onclick="window.open(this.href);return false;

Re: Friendswood: Man arrested for pulling gun on trespassers
Since an arrest without warrant must be based on probable cause, I think the arresting officer had reason to think that Mr. Decherd committed the offense of aggravated assault. The article quoted the police chief, so the arrest apparently was approved up to that level.TxD wrote:Or do you think that the arresting Officer talked with the parties involved, interviewed a few other witnesses, and spoke to his supervisors before he placed Decherd under arrest?
In the case of a felony, I would be surprised if the police would bring a charge without approval from an assistant DA.
Cases involving oral threats are problematic because the only evidence is witness testimony, and the perception of a threat can be subjective.Sec. 22.01. ASSAULT. (a) A person commits an offense if the person:
(1) intentionally, knowingly, or recklessly causes bodily injury to another ...;
(2) intentionally or knowingly threatens another with imminent bodily injury...; or
(3) intentionally or knowingly causes physical contact with another when the person knows or should reasonably believe that the other will regard the contact as offensive or provocative.
Sec. 22.02. AGGRAVATED ASSAULT. (a) A person commits an offense if the person commits assault as defined in Sec. 22.01 and the person:
(1) causes serious bodily injury to another, including the person's spouse; or
(2) uses or exhibits a deadly weapon during the commission of the assault.
Now, it is possible that Mr. Decherd's actions were justified, but it probably will cost a lot in legal fees to find out.

Re: Friendswood: Man arrested for pulling gun on trespassers
True enough, but all legal justification for doing so evaporates when party B is trespassing. Trespassing while carrying a firearm is a class A misdemeanor even with a CHL. (I hope everyone has that squared away.)casingpoint wrote:The problem with pulling a gun on somebody without cause and then not using it, is they might pull one on you and use it with the cause you provided.
PC 9.31. SELF-DEFENSE. (a) Except as provided in Subsection (b), a person is justified in using force against another when and to the degree the actor reasonably believes the force is immediately necessary to protect the actor against the other's use or attempted use of unlawful force...
(2) did not provoke the person against whom the force was used; and
(3) was not otherwise engaged in criminal activity, other than a Class C misdemeanor that is a violation of a law or ordinance regulating traffic at the time the force was used.
PC 30.05. (d) An offense under this section is:
(3) a Class A misdemeanor if:
(B) the person carries a deadly weapon during the commission of the offense.

Re: Friendswood: Man arrested for pulling gun on trespassers
Through the miracle of Google street views, you can see the "crime scene." It looks like there is plenty of room to park on the shoulders of the road. The weather has been dry around here, so it should not have been muddy.
OTOH, I know from my days as a horseback rider that many people act like they own the unpaved right-of-way in front of their property. They don't.

Re: Friendswood: Man arrested for pulling gun on trespassers
I dunno. I wasn't there. Here is what the article says:
- JimWhen the couple returned to their truck about 2:50 p.m., a man who was riding a John Deere lawn mower approached [them} and yelled at them to get their truck off his property.
When [the vehicle owner] explained why they had parked there, the man pulled a gun from his shorts.
[The vehicle owner's wife] was in the truck and began honking the horn.
Her husband moved the truck into the road.

Friendswood: Man arrested for pulling gun on trespassers
On Wednesday a small plane crashed in Friendswood (incidentally, about a mile from the PSC range). Yesterday the NTSB held a news conference near the site to explain that they didn't have a clue why the plane crashed ( ).
The sister of the deceased pilot and her husband reportedly parked their vehicle in the driveway of a house across the street from the site. The property owner approached them and told them to get off the property, then "pulled a gun from his shorts."
Friendswood police arrested him and charged him with aggravated assault.
