I've shot around LEO's at various ranges. Its more the range nazi's I would worry about. Like DFW Shooting Range where they would actively stop people from shouldering braces, etc.powerboatr wrote: ↑Fri Jun 02, 2023 10:47 amthis made me wonder...does law enforcement frequent your local range to SEE what people have???Rafe wrote: ↑Thu Jun 01, 2023 11:35 amTL;DR: We're likely to win this battle...eventually. But the new rule went into effect at 00:00 today and even if you're an FPC member in Texas whose membership was active prior to their filing the injunction, don't take your pistol-with-brace combo to the range because you very well still might be arrested and have to defend your position.
From what I've seen so far, all plaintiffs who have filed, including GOA, are wanting the best possible chance at receiving an injunction for relief so they've kept the scope of the filings very narrow. But it's eventually going to take a case that addresses all owners of pistol braces who, for a decade, had been assured by the ATF that they were legal. And that might mean it will have to go to SCOTUS...and if so, we may not get this 2nd Amendment overreach overturned until 2025.
our range has one day a month for local police to practice and "STUFF" and range is closed during those 4 hrs, you can watch...just no firing line setup or shooting
other than that LEO are never there. but in some cities i guess it would be an easy picking day for leos

“We are very excited and encouraged by the Fifth Circuit’s decision this morning,” Cody J. Wisniewski, Senior Attorney for Constitutional Litigation at FPC Action Foundation, said in a statement. “We intend to ask the Court for additional information about who is covered under the injunction, but cannot stress enough just how important this decision is.”

Re: ATF Released New Proposed Pistol Brace Rules
I'll let any lawyers chime in, but my understanding is that the "as to plantiffs" part means it rules in favor of the plantiffs, not just "for the plantiff". Therefore Texas and the rest of the area covered by the 5th Circuit has injuction relief.rtschl wrote: ↑Tue May 23, 2023 2:29 pmExcept the injunction may only apply to members of FPC who are the plaintiffs - no one else. If true, then that is a travesty for those that own them and not a member of FPC. That would mean the new ATF rule still applies to anyone else in the 5th District as well as all other districts. I don't think I have seen such a limitation of a 2A lawsuit before. Hopefully, the reporting is wrong on this and the injunction is for all in the 5th District.

What we have here is clear evidence of oligarchy:

Congressional Witness Admits Bloomberg Gun Control Group Asked ATF for Pistol Brace Rule
Jordan asked Wilcox, “Did you or anyone in your organization communicate with the ATF or the Biden administration about these issues we are discussing today, prior to the notice of proposed rulemaking?”
Wilcox responded, “We submitted a formal petition for rulemaking through the formal channel, sir.”
Jordan then pressed for certainty, asking, “Before the notice of proposed rule making?”
Wilcox responded, “That’s correct.”

Re: ATF Released New Proposed Pistol Brace Rules
The Second Amendment protects an individual right to possess a firearm unconnected with service in a militia, and to use that arm for traditionally lawful purposes, such as self-defense within the home.
Scalia noted the individual right was designed so that any citizen could own and bring to service in the militia a weapon suitable for use as an individual soldier.
But the most recent military rifle used by individual soldiers is the M4 carbine, which has a 14.5-inch barrel. Hmm—that makes it a short-barreled rifle. If the military is using SBRs, then the determinations in Miller and Heller that a weapon be in common use and suitable for use in the militia are satisfied. The ATF attempt to regulate them should be overturned and the NFA modified to acknowledge this reality. I’m pretty sure Justice Clarence Thomas already noticed that and is just waiting for the right lawsuit to come the Court’s way

Why the ATF’s Pistol Brace Ban Is Unconstitutional
The nearly 90-year-old federal law restricting short-barreled rifles has been superceded by time and technology. It’s past time the Supreme Court took notice.

You’d better get it straight that it’s not a bunch of boy scouts you’re up against — then you’ll know that this is not the age for beautiful gestures. We’re after power and we mean it. You fellows were pikers, but we know the real trick, and you’d better get wise to it. There’s no way to rule innocent men. The only power any government has is the power to crack down on criminals. Well, when there aren’t enough criminals, one makes them. One declares so many things to be a crime that it becomes impossible for men to live without breaking laws. Who wants a nation of law-abiding citizens? What’s there in that for anyone? But just pass the kind of laws that can be neither observed nor enforced nor objectively interpreted — and you create a nation of law-breakers — and then you cash in on guilt. Now that’s the system, Mr. Rearden, that’s the game, and once you understand it, you’ll be much easier to deal with.” [from Atlas Shrugged]

ATF Released New Proposed Pistol Brace Rules
As expected its bad... but actually even worse than I imagined in that they are adding all kinds of weight/length requirements to the definition of a pistol. Evidently they propose to turn millions of pistols into SBR's with no legislative process.
