Very illuminating.
IIRC, the original drafts of the bill providing Defense to Prosecution were actually much cleaner "Exceptions". I'd love to know why the legislation was changed to the current "defense to..." language, but, I'm happy to have it.
I've found myself having to use the restroom in a damaged public school while volunteering after a tornado, and again volunteering in a shelter set up in a school gymnasium after a hurricane.

The only requirement for being on-duty is for chapter 46/schools.

If I was on the jury, I'd do my best to get you an acquittal, but, IMO a CPR card doesn't meet the volunteer definition.
I'm not going to ask for the AG to give an opinion, but being a test case can be expensive and cost you your license.

There was some discussion about volunteer vs paid professional first responders. Seems that HB 435 applies to volunteers only and paid full time professionals are not covered.... My wife is an EMT and the law applies to her when she is actively engaged in her duties as an EMT. Such as carrying into a posted hospital with her patient. This doesn't mean she can carry anywhere at anytime when she is off the clock. This is my interpretation of the law.
Just a caution.... I might not have the correct understanding...
