Re: ANTHONY KENNEDY IS RETIRING!
It's my understanding that in MD, until 1996, the acts that Dr Ford alleges would have been a misdemeanor, with a 1-year statute of limitations.
Doesn't make the act, if true, any less egregious. But, it does make it unprosecutable today.

Re: ANTHONY KENNEDY IS RETIRING!
Napolitano on Kavanaugh.
Filling The Swamp
Filling The Swamp
Now he has given us a nominee to the highest court in the land who typifies the culture he railed against when he claimed he'd drain the swamp. This man and this culture accept cutting holes in the Fourth Amendment because they don't believe that it should protect privacy. This man and this culture accept unlimited spying on innocent Americans by the National Security Agency because they don't believe that the NSA is subject to the Constitution.

He's a non-starter for me...
https://www.dailywire.com/news/32411/ru ... en-shapiroKavanaugh upheld Obamacare in Sissel v. Department of Health and Human Services as well as in Seven-Sky v. Holder, in which he stated that the Obamacare penalties were actually “taxes.”
Kavanaugh's pro-2A ruling and several rulings against bureaucratic overreach are encouraging, but he appears to be reluctant to rein in domestic spying (warrantless data collection on US citizens) and was also deferential on the Obamacare "tax"...
Obviously he's light years ahead of Ginsburg, Kagan and Sotomayor on all of these things, but, Kethledge would have been my pick.
I guess "non-starter" was a bit overstated...
"Last of the best"... "Fourth of Four".... maybe?

Re: ANTHONY KENNEDY IS RETIRING!
If the confirmation is finished in October then, the Democrats can't use it to motivate their voters in November.
We'll, it'll be a less impactful anyway.

The Senate would still be majority R's, so, Shillary wouldn't have been able to push through a real Prog.rotor wrote: ↑Wed Jun 27, 2018 3:15 pmWhat I was thinking is that Obama might have withdrawn Merrick and let Hillary pick a real progressive. Who knows.RoyGBiv wrote: ↑Wed Jun 27, 2018 3:11 pmIf Shillary won, the Senate would have approved Merrick, lickety split.rotor wrote: ↑Wed Jun 27, 2018 3:01 pm Just think of what McConnell did when Obama picked Garland for supreme court. The gamble of letting Garland go through, moderate liberal they say, blocking him and having Hillary win and pick a flaming liberal, or having Trump win and pick a conservative and we all know that Trump was never going to win. I don't know if McConnell has a time machine or could just see into the future. I would not want to play poker with a man that maneuvered that hand or was it just plain luck! Worked out for those with conservative leanings.
