Looks like the D.A. may consider this a "reasonable" action under 9.22 / 9.32?
Hasn't gone to the DA yet. Department put out an update yesterday morning saying they were still investigating and it will be presented to Tarrant Co. DA next week. Couldn't find it on their main website but they have put out 2-3 updates via their Facebook page.

From what I read, 2 guys argue and the LTC holder gets in his car. Smith then comes up from behind reaching in his waist band like he is fixing to pull a firearm. Fearing for his life, the LTC holder stops the threat.

From what little the story says I believe this is justified from what we have so far. Way to early to tell though. If I would he been in the LTC holders situation and seen someone come up behind me reaching, first thought would be, I'm fixing to be executed if I don't act.
