Actually, the penal code definition of the offense is: "creates, by chemical means, a noxious and unreasonable odor in a public place." Sounds like a conventional fart, regardless of how deadly, would not get your CHL yanked.

Uh, how do you think that gas is created in the body? ;-)
I would argue in court that it's biological, not chemical. :rules:
I would argue that it is biochemical.
In my book, that's still an acquittal. :smash:

I did "counsel" a young man for that once upon a time...but he went out of his way to "create a noxious odor in a public place", specifically our tool room at a hangar. He would eat eggs at the chowhall each morning, and was taking that "weight gainer" protein stuff to help him "bulk up" when lifting weights. I admired his desire to be physically fit, but nobody could stand being in the same room with him. I could see somebody wanting to do him in if he would have kept that up!

DING DING DING, we have a winner. Officially it is biochemical, but is still a chemical means. I am sure the statute was aimed at 'stink bombs' and other types of things made to create obnoxious odors, but think the way it is written could still get you arrested.

This reminds me of a George Carlin skit which can't be repeated here because of the 10 yo daughters.
We declare our right on this earth to be a man, to be a human being, to be respected as a human being, to be given the rights of a human being in this society, on this earth, in this day, which we intend to bring into existence by any means necessary.

You know, deadly force in response could have been justified, depending upon how "deadly" the neighbor was. How frequently he was gassy could have also been considered disparity in force!

I raised 4 daughters. The answer is yes, they do. Trust me!

Reminds me of when the cop pressed charges on a guy that farted in his direction
