DA has no plans to charge vandal.

wow :lol: i've never heard of anyone breaking their finger from shooting a gun..... just more media adding more koolaid for the unknowingly.

the punk was lucky his buns were the only thing that was toasted....

Looks like Harris County needs a DA removed from office and replaced.

The trucker was arrested and will face aggravated assault charges.

Police said there were multiple 18-wheelers with flat tires outside of that apartment complex.

Despite the apparent vandalism, deputies said the district attorney's office has no plans to press charges against the vandal.
Wait, what???

So it's ok to slash tires now but not ok to defend against the destruction of your property?

Things that make you go hmmmm.... :headscratch
The laws that forbid the carrying of arms... disarm only those who are neither inclined nor determined to commit crimes.

I tried finding the arrest affidavit online but it doesn't show up yet. I am curious to read it. Not sure why the DA isn't filing charges. Maybe they will charge the guy at the county court level on misdemeanor cases? We shall see.

What property was he trying to recover?
What deadly force was being used against the shootist?

deadly force is used to stop unlawful deadly force !!

Fleeing criminal mischief or destruction of property perpetrators usually dont fall into the deadly force statutes ! :rules:

Perp is lucky all he got was a bullet in the rear. Slashing tires on a bunch of 18 wheelers could have got him killed. Wonder how much those tires cost? As far as I am concerned the trucker was asleep in his "home" which was being invaded.

My initial reaction was the same as yours but then I thought about it a bit. What "criminal mischief" was he doing 100 yards down the street? He wasn't shot at the time of the reported violation but down the road attempting to flee. If he was still anywhere near the truck, even if fleeing, I would agree but 100 yards away? Then it's shooting someone for committing a misdemeanor. Honestly I'm not going to get real worked up over it but I don't think that the law was meant for that.

I don't agree with the shoot but the DA's refusal to charge the tire-slasher smacks of UK-style backwards justice to me...

We do not have the complete law of 0:42 until we reach the period and a new P C begins ; there is a semi colon and the word and.

now read 3 B. it is very plain.

fleeing criminal mischief perps are not endangering shooter

" any force less than deadly force would expose the actor to death etc etc"
