That is silly. Let us see the judge is sane enough to dismiss the charges.

He would have been better off shooting the sonnavagun.

No good dead goes unpunished.

He should of used his double barrel shotgun and gone out on the balcony and blasted two shots into the air. All would be ok then.

His life was not in danger, so If he shot the burglar he would be in worse shape.

“There was nothing that the suspect was doing that was aggressive enough to justify the shooting,” Lt. Mike Budreau told KDRV. “In fact, the suspect was walking away.”

I hope Lt. Mike Budreau likes his job and feels good about himself.

He was on Hannity's radio show today along with Master Sgt. CJ Grisham. Hannity said he was going to have them both back for his TV show.

Because the good Lt was standing right there and knew with precisely how much force should be applied before a home invader is aggressive enough to be shot. Idiot.

Just for all the criminals out there I don't do warning shots.....if I am sufficiently threatened enough to shoot it is coming center of mass.

Yes, sir, Lt. Paper Pusher because a guy who has broken into somebody's home might be there just for a glass of iced tea.

THIS...

I have two modes.. Not threatened, and threatened.. One results in a stern word and perhaps even the offer of a beer.. the other results in a coroner's service being required,, cuz my task at that point is to stop the threat.. and the likely result is the death of the attacker.. Not required or even desired,, but not my concern either... Just stop the threat.

If the suspect was really walkIng away what was the justification for the warning shot? That seems like a poor decision. Now the lawsuit is ridiculous.

It's a result of the poor training the military has been giving out lately.

When I was in the military in 2001 we had to get escalation of force training to man the gate at Camp Foster in Okinawa, Japan. We were trained and issued M1014 shotguns and put on patrols all around the base. We also manned the front gate. We were explicitly told to never, ever fire warning shots for two excellent reasons: 1) the person you are shooting at may assume you are a terrible shot and return fire accurately and 2) you have no idea where the round (buckshot in this case) was going to go or what it would hit.

Later on when I was in the Army they trained us to fire to warn, disable and finally kill. Which is where this gentleman got the wrongheaded notion that shooting warning shots is totally ok. Sounds like he was trying to detain this person and fired the shot to force the issue. The training he got ended up biting him back. Hopefully he learned his lesson and won't be popping off shots in suburbia anymore.

This house doesn't call 911. Or fire warning shots.
