Wouldn't that be the normal course which would occur to any of us who use our weapons?
The police would have very little choice but to arrest and charge. That's what they do.
IMO, it would be up to the DA and a Grand Jury to bill or no-bill.
Or is my understanding flawed?
Best of luck to the victim in this case.

I wonder if the "victim" had the ability to remain silent?

So was the guy a car jacker or a car thief? Those are not really the same terms. The thread title implies the guy was forced out of his car, but his car was stolen and he chased it down.
Who leaves their keys in the car these days?

Not a carjacking because no force was used
http://cbs7.com/multimedia/article_103f ... b2370.html" onclick="window.open(this.href);return false; From the article:
Parker said no force was used to take the vehicle, because it was left at the truck stop running with the keys in the ignition.
This incident is being referred to officially as "Unauthorized Use of a Motor Vehicle."
Wasn't the smartest move to go after the 'unauthorized driver' IMO. This guy is going to have a rough legal battle.
Shooter has a 'Go Fund Me' page set up by a family member to try to get money for legal defense
" onclick="window.open(this.href);return false;. It has the families take on the incident.

File insurance claim? Kick self in head for leaving keys in car.
