Afghanistan: Green Beret who murdered Taliban bomb maker charged

Is this remnants of the Obama Administration's investigation, or is there really something to this?

Apparently the bomb maker killed two US Marines.

Or does this fall under what happens in Afghanistan should stay in Afghanistan?

This is a shame. War is hell. WWll the only rules of engagement were WIN. When you handcuff the Military Good Guy casualties go up by leaps and bounds. Turn him loose and turn our military loose to win the war they are in.

Allegedly murdered, hasn't been convicted despite his best efforts.

He was cleared by the Army, then couldn't keep his mouth shut and gave Fox News an interview. :banghead:

So a commander acted independently by carrying out his own threat assessment based upon ground level intelligence, reached a different conclusion than the CIA, and removed a threat?

And our Army's response is "charge this man with murder"? They make it sound like shooting the prisoner in the head behind the camp would've been fine except that he wasn't on the CIA's list, which is the exact type of centralized thinking that plagued our efforts in Vietnam, from LBJ picking bombing targets down to analagous situations with the Phoenix program. The real failure here appears to be that the command structure wouldn't listen when the accused told them that the prisoner was in fact a threat.

Ford pardoned Nixon before he was even indicted.

Once someone is charged under the UCMJ, it is a crime to exert "command influence," although no commander has ever been procecuted under the Unlawful Command Influence (UCI) section of the UCMJ. I believe POTUS should/must remain unbiased until after any trial and verdict before any action is, or is not, taken.

Trial by military court martial, not a civil trial, judged by military personnel, but I get your point.
