Don't most instructors already do that? Teach a long class for new students and a short one for renewals? I'm not saying DPS will expect applicants who paid before 9/1 to take the long class but stranger things have happened.

That's true. The requirement to have NRA instructor certification is a good example.

What exactly would DPS have to gain by digging in their heels? If there is any leeway whatsoever I doubt it would be an issue.

Seriously? It's called a bureaucracy. It doesn't have to make sense, or gain anything for them.
I agree, however most people consumed in bureaucracy are just plain lazy. The easy way out (involves the least amount of effort) is to accept the shorter class.
I bet it doesn't wind up being an issue.

There is no way that this is going to be an issue. Come Sept 1, everyone is going to be on the short course and they are not going to penalize individuals that signed up for it prior to that date. There is no way that we as instructors know, and EVERYONE will be teaching the short course

The truth is we don't know what DPS will do until they tell us. Logic doesn't always apply to bureaucracy.
When in doubt
Vote them out!
