Battle Ship Texas question for CCW's
To all
This is what is posted for the Texas State Parks. Does this count for us CHL holders?????? I will be doing a overnight campout on the Battle Ship Texas in a few months and I wanted to know. Also is it posted?
f) Arms and Firearms.
It is an offense to:
1. possess a firearm with a cartridge or projectile in any portion of the mechanism, except when authorized by the commission or the director;
2. display a firearm, except when authorized by the director; and
3. discharge across, in, or into a state park any arm, firearm, or device capable of injuring or killing any person or animal or damaging or destroying public or private property except when authorized by the director.
Thank you,
Calvin

It is not illegal for a licensed CHL holder to carry in a Texas State Park...

Now, having said that the battleship Texas is located within the San Jacinto Battlefield State Historic Site, but is administered by TP&W. It may or may not technically be a State Park.
It might be worth a phone call to clarify this issue before you go.

And it doesn't.KBCraig wrote:Doesn't matter if it's an "historic site" or state park. If it's owned by the State of Texas, or any political subdivision thereof, it's not off limits unless it falls into one of the categories specified by the Legislature.
The law passed in 2005 supercedes the order cited above.
But I am curious. Some years ago, while I still lived in RI, I visited The Alamo. At the time, I noticed it was posted, though I do not remember if the signs were 30.06 compliant. Does anyone know if it is STILL posted, and if the signage is valid?

There were no signs last time I was there (a year ago). If there were a sign it would be meaningless.frankie_the_yankee wrote:And it doesn't.KBCraig wrote:Doesn't matter if it's an "historic site" or state park. Thanks to all. I did see that one question sparks a different one. See this is good for us to have this site. It brings us CHL holders together in all ways. THanks Mr. Cotton for having it.

The Alamo question comes up periodically. Basic answer it is a state-owned facility, cannot be legally posted, and you can carry there. If you want to know more:

Good to know about the battleship too.

Before answering this, I was checking the Parks and Wildlife Code to be sure. I found something interesting in there that MIGHT make a difference. It seems that there is a private foundation for the San Jacinto Battlefield that helped raise funds for it and whatnot. The interesting part was a clause that says that any property that was theirs is still theirs. So, if they raised the money to get the Texas moved there, it might possibly be private property.
I don't know if it is or not, or how to verify what the legal status is. I just raise this point out of curiosity and to warn people that things are not always as they seem on the face.

Some friends and I went to Battleship Texas in May and it was not posted then. I carried then because it seemed to me to be a state park. But now that you say that the foundation is private, I am not so sure. I do know that the two exhibits, the monument and the battleship, each have separate entrances, parking lots/ticket booths, and gifts shops. Not sure if that make a difference or not.

This is speculation. I can find web sites that say the USS Texas was deeded to the state, and nothing that says ownership was transferred to a private foundation.GKings1 wrote:But now that you say that the foundation is private, I am not so sure.
I very much doubt that the state would give the ship to a foundation that could potentially go bankrupt. The ship is a national treasure, like the Alamo.

I want to clarify. I do not know if the Texas is private or not. I found the law saying the foundation retained ownership of property it had, but I do not know if that included the Texas or the land around it or some of the memorabilia or what. I included it more as a note that some things are not what they seem. A similar situation in this respect is the Alamo, where many people think the DRT actually owns it instead of just managing it for the State which owns it.
If the Texas is state park owned, you can carry. If it is private, it would have to be posted to stop your carrying.
