Holsters

To carry open, I've read you have to have a shoulder or belt holster... Will a hip holster work? As far as abiding by the law i should say.

If I just clipped it to my belt, does that make it a belt holster?

There are multiple 8+ page threads on this. Really if it is a holster, is in the waist region, and you have a belt. You are probably going to be okay.

Wasn't bashing you for it, just pointing them out as a "you will never get a straight answer". The law says belt holster, but that term is never defined. As an example some people say a paddle holster doesn't count, some think it does. Until the legislature defines it, or we get some court cases on it. /shrug

Which is why I gave the answer I did.

I see! No offense taken at all. Thank you for the response. The holster I have can go in the waste or on the hip but the clip can easily be clipped to my belt so im pretty sure I'm ok.

While it may not be interpreted as a belt holster by some police departments, here is what Houston PD says about "Belt Holster" in the Open Carry page http://www.houstontx.gov/police/open_carry/index.htm item #26.
What is a “belt holster” and what kind of holster would be a violation?
The law does not define a “belt holster”; the law just states you must carry your handgun in a “shoulder or belt holster.” A “drop down” holster attached to your belt is considered to be a belt holster.

I'll bite. What is a hip holster and how could it not attach to a belt or the waistband where a belt would be if one was worn? Are we simply talking about a paddle holster here by another name?
