Statutory No Carry Zones

I posted this in a different thread but I thought I would re post as it may help
I keep this printed off and in my vehicles as a reference


1 - Premises of a School
2 - Premises of a Polling Place
3 - Premises of a court or any office used by the court
4 - Secure area of an airport
5 - Premises of a race track
6 - within 1,000 feet of the Premises of the location of a death chamber on the day of an execution

7 - 51% rule, if it smells like a bar then its a bar
8 - Premises of a professional sporting event
9 - Premises of a interscholastic event
10 - Premises of a correctional facility
11 - Premises of a hospital
12 - in an amusement park (county more than 1 million people and park is more
than 75 acres controlled entries and is open at least 121 days a year
and has security guards on premises at all times)
13 - church or other place of worship


"Premises" means a building or a portion of a building. The
term does not include any public or private driveway, street, sidewalk
or walkway, parking lot, parking garage, or other parking area.

Subsections (b)(4), (b)(5), (b)(6), and (c) do not apply if the actor
was not given effective notice under Section 30.06
b4 = Hospital - they must post 30.06
b5 = amusement park - they must post 30.06
b6 = Churches and such - they must post 30.06
c = A license holder commits an offense if the license holder intentionally,
knowingly, or recklessly carries a handgun under the authority
of Subchapter H. Chapter 411, Government Code, regardless of,whether the
handgun is concealed, at any meeting of a governmental entity.

City hall meeting must post 30.06
Just make sure the court does not have
an office on the Premises as defined above

One is not prohibited from conceal carry in a church or other place of worship unless there is a proper 30.06 sign posted, or effective verbal notice given.

He has the 30.06 must be psoted requirement. You just have to read lower like in the real statute. ;-)

The professional and interscholastic sporting event premises must be during the event. No?

National Parks Gun Law Takes Effect in February

A new law permitting concealed loaded firearms at National Parks will not take effect until February and the Interior Department will continue to enforce Reagan-era restrictions until then, a spokeswoman said today.

"Under the current regulation, firearms are generally prohibited, but citizens may transport unloaded and dismantled or cased firearms and carry firearms while participating in approved hunting programs and under certain other circumstances," Interior spokeswoman Kendra Barkoff said in a statement released minutes after President Obama signed the credit card holders' bill of rights, which includes an amendment allowing firearms at the nation's National Parks and wildlife refuges.

The department plans to work on implementing the new law in the meantime, focusing especially on public safety and the safety of National Park employees, Barkoff said. Permission to carry a firearm into a park and the actual restrictions on such possession will vary by state, since the new federal law is governed by each state's firearms laws.

This week both the House and Senate approved Sen. Tom Coburn's amendment to the credit card bill. The Oklahoma Republican and a bipartisan coalition of lawmakers has tried for years to get the measure approved, arguing that differences in state and federal firearms restrictions made it difficult for gun owners to travel between state and federal lands. Interior instituted new regulations in the waning weeks of the Bush administration, only to have them rejected by a federal judge in March. The Obama administration refused to appeal the decision and the president signed today's bill with no comment on the gun provisions. Approval of Coburn's bill is yet another of several recent setbacks for gun control advocates.

You are correct, I guess I "jumped the gun" and was thinking State Parks and LCRA parks

EVERY TIME I GO FISHING, I HAVE TO RESEARCH WHO OWNS THE PARK PROPERTY SURROUNDING THE WATER NOW, then, in addition to learning the fishing bag limits and sizes, perform legal research to attempt to see if I'm allowed to protect myself from the rattlesnakes on that property or not.

I know that Corps of Engineers Parks/Empoundments/Reservoirs are a pain

In most cases firearms are prohibited on Corps properties, except while hunting in authorized/designated hunting areas.

Part 327 section 327.26 of the Code of Federal Regulations makes it legal to carry on COE property by stating that state and local laws shall apply on project lands and waters including the use and possession of firearms.

Title 36 Code of Federal Regulations, Part 327 governing use of Corps of Engineers Project Lands and Waters

327.13 Explosives, firearms, other weapons and fireworks.
(a) The possession of loaded firearms, ammunition, loaded projectile firing devices, bows and arrows, crossbows, or other weapons is prohibited unless:
(1) In the possession of a Federal, state or local law enforcement officer;
(2) Being used for hunting or fishing as permitted under 327.8, with devices being unloaded when transported to, from or between hunting and fishing sites;
(3) Being used at authorized shooting ranges; or
(4) Written permission has been received from the District Commander.
(b) Possession of explosives or explosive devices of any kind, including fireworks or other pyrotechnics, is prohibited unless written permission has been received from the District Commander.

Found this:
Beginning in 2009, Federal rule changes give gun owners permission to carry concealed firearms in national parks, as long as their concealed firearms permit is recognized by the state in which the park is located. March 19, 2009, a federal judge blocked this Federal rule, issuing a preliminary injunction. The NRA has appealed this Federal court ruling which blocked the policy allowing people to carry concealed firearms in national parks. This issue is yet to be resolved. Issues pertaining to firearms on federal property, particularly in federal buildings or facilities, is subject to federal law and regulations. A person should always contact the appropriate federal authority when his travel plans involve federal properties.


So, in Feb. 2010 we can in National Parks?
Well, guess I'll vacation elsewhere until then, or until it's set in concrete
