I don't disagree with anything you say. I do think we worry to much about giving anti's ammunition, they don't need it. It has been evident over and over that it doesn't matter what the anti's are given are not given. They will continue their campaign. In fact I suspect they would rather use false hoods than something we may give them. This way they can be more creative, like the idea of abolishing parts of the second amendment.

But as I said, I don't disagree with you thoughts on this.

Hold on a minute. Isn't it irrelevant whether or not a "no guns" sign in a hospital is compliant, because carrying a gun into a hospital is illegal, regardless?

That depends what state you're in. In Texas, the restriction does "not apply if the actor was not given effective notice under Section 30.06."

They used to be, but as Tamie said, know they must post according to 30.06 or give effective notice some other way.

Whoa. So basically you're saying that it doesn't matter WHERE it is - a police headquarters, hospital, FBI office, capitol building, whatever... if there's not an official notice, you can carry???

Nope.

The Texas Government and Penal Codes specifically detail places licensed concealed carry is prohibited by law, what (if any) notification needs to be posted/communicated by those places, and what constitutes criminal trespass. You can browse or search through all Texas statutes at http://www.statutes.legis.state.tx.us/. A good place to start for laws affecting CHL is at the DPS Website: http://www.txdps.state.tx.us/administra ... sindex.htm, specifically the compendium of Texas Handgun Laws: http://www.txdps.state.tx.us/InternetFo ... CHL-16.pdf.

Specifically, in this case, you have to keep reading PC §46.035 below:
PC §46.035 wrote:(b)(4) on the premises of a hospital licensed under Chapter 241,
Health and Safety Code, or on the premises of a nursing home licensed
under Chapter 242, Health and Safety Code, unless the license
holder has written authorization of the hospital or nursing home
administration, as appropriate;

(b)(5) in an amusement park; or

(b)(6) on the premises of a church, synagogue, or other established
place of religious worship.
When you come to PC §46.035(i) you see: "Subsections (b)(4), (b)(5), (b)(6), and (c) do not apply if the actor
was not given effective notice under Section 30.06."

He was responding to a comment about hospitals and his reply applies to hospitals. If your statement regarding all those other places wasn't sarcasm, I hope you haven't actually been through a CHL class yet, because if you have, you need to get your money back. :cheers2: You named 3 different categories of buildings and each can have a unique application of the law.

Here's a freebie, if you were serious, this will turn your world upside down. :smilelol5: The State Capitol has an express entrance for CHL holders. Yes, if you have a CHL you can bypass the lines and security the general public must go through. :txflag: And a bonus, but should be a given, an FBI office is a Federal facility which is a different ball game. :patriot:

So I go to Chuck E. Cheese's at Katy Mills last Saturday night with my wife and nephews and when I get through the front door I see this sign on the wall to the right, I see the wording looks right, so I kinda panicked and ran to the car to disarm myself :leaving
I go back into this place and when I take a second look at it I realized the letters were too small, not even half an inch tall, so I guessed it's not enforceable. :headscratch
Anyway I was already disarmed and was not gonna go back to the car to get the Glock. Felt kinda stupid but oh well, felt I should take a picture of it to share with everyone here.

Do the people that post this signs know they are not enforceable??? Are they just plain ignorant or they do it like that on purpose so CHL holders can carry and Insurance Companies have to pay up if something happens?? Are insurance companies ignorant? Don't they know this sign is as good as a gun buster sign??

Any thoughts?

...there's only one way we can find out for sure why businesses post unenforceable signs which have some of the characteristics of the required 30.06 sign...and that's to ask them...why do that and risk the fact that they're serious about it and give you a verbal notice??? why point out their error and prompt them to correct it? why take the chance of burning the local, gun-loving manager who was told by corporate to put up a sign but didn't want to lose his loyal base of gun-toting customers by doing it correctly?
...I choose not to know the answer, not to let them know I'm smarter than they are about it...and quietly excercise my legal rights to carry concealed where there is no proper sign...some of life's questions just don't need answers...them's my thoughts...

Yeah that's why I didn't want to ask them, I guess we'll never know for sure, all I know is that I will carry next time I go there.

When a business chooses to post a 30.06, they're taking on the moral responsibility of "second-guessing" the entire Texas CHL program and more likely increasing risk than reducing it.

If they don't post, OTOH, Texas law dictates who may carry there which would seem to be a morally-sound way to "wash their hands" of the matter.

Only a naive person lacking common sense would see 30.06 posting as the better choice.

I'm wondering just how far they would go in enforcing that last sign. It's not valid, but it says "violators will be arrested and prosecuted." Has anybody run into attempted enforcement of one of these "invalid" signs? Could things be straightened out on the spot with the arresting officer? Even if I know I have the right to carry, I'm really not in the mood to interrupt a relaxing afternoon drive with my wife with being arrested, cuffed, and taken to jail, possibly for several days, before having the opportunity to defend myself in front of a judge. That would be something of a, er, headache.
