just an FYI if you ever go someplace and they post a .51% sigh (a restaurant ) you can go to the TABC and request a printout showing the amount of revenue they make from alcohol and if it’s not 51% or better you can file a complaint and have their lic to sell suspended

The sign color (red or blue) is public but I was told the specific amount they make from alcohol is not public information. What's the trick to get those details?

It has to be a red number .51 and you can write the tabc and request the info under the info freedoms act. This is public info because they sell to the public

I'll try again. The color of the sign is public information. That's well established.

I'm asking how to get their actual alcohol sales when TABC says that's not public information. They also say the diagram showing the licensed premises is not public information.

the alcohol lic has be posted for the public to see.you can get the number off of the permit. TABC can't refuse you the info because it is public info under the freedom of info act. A diagram of the building also public info but you is going to have to do a search of city records for that or the tax office because they pay tax by the BLD footage

Also, is it possible to get the diagram showing what part of the property the TABC license covers? Not a diagram of the building but the actual diagram they must include with the application showing the area covered by the license.

TABC will tell you THE ACTUAL amount of sales they report. it has to be 51% or better of their total revenue before expenses for them to post a sign. The law in Texas says you can sell/serve alcohol that is a controlled area. That area can be a porch, fenced area, roof top or the restrooms. I have seen a place nail pallets together in the parking lot and sell beer inside of the pallet walls

Four signs are required to be posted at an on-premises retail establishment:
•Weapons Warning Sign - If alcohol sales constitute less than half of gross receipts, the required sign says: "It is unlawful to carry a weapon on the premises unless the person is licensed to carry the weapon under the concealed handgun law." If alcohol sales constitute more than half of gross receipts, the signs have 51% in large red letters superimposed over the warning which notes that possession of a concealed weapon on the premises is a felony.
•Public Interest Information Sign - If you have a complaint about the sale or service of alcoholic beverages in this establishment, please contact the Texas Alcoholic Beverage Commission, PO Box 13127, Austin, Texas 78711-3127, or phone 1-888-THE-TABC.
•National Human Trafficking Hotline Number (English and Spanish) - WARNING: Obtaining forced labor or services is a crime under Texas law. Call the national human trafficking hotline: 1-888-373-7888. You may remain anonymous. (Restaurants that hold a Food and Beverage Certificate are exempt from this requirement.)
•Health Risk Warning Sign: Warning of the dangers associated with drinking alcoholic beverages during pregnancy. Visit our Fetal Alcohol Spectrum Disorders page for more information.

This is not going to be on their web site, the only thing that shows up there is a quick search. If you want to find out what they pay tax on (sales) you have to file a freedom of info act paperwork stating that and in within ted days they have to release it or tell you why they are not and I don't see any reason they can refuse you. The web site just says if they are a blue or red sign (over 51% or under)
