Ok, i understand this is probably a stupid question, but does the posting below satisfy the 30.06 or does the town ordinance suffice?

"The possession of firearms and other weapons or explosives are prohibited by Town Ordinance."

This is posted in small white letters on a general rules section in the front foyer of the rec center.

Not legal for 30.06 and there can be no town ordinance superseding state firearms laws.

If this is a city owned property, then it can't legally be posted even with 30.06 unless they hold city meetings there and only when they meet.

Ok, so If I understand it correctly, since the sign is not 30.06 spec and its a city location where no city meetings or business are held, than carry is ok regardless of the sign?

The only caveat might be if you sign any kind of agreement to use the facility that says you agree to no firearms, then they might be able to revoke your membership to the rec center, but legally they can't arrest you unless you refuse to leave.

The State statute says

Sec. 235.023. PROHIBITED REGULATIONS. This subchapter does not authorize the commissioners court to regulate the transfer, ownership, possession, or transportation of firearms and does not authorize the court to require the registration of firearms .

The county can not regulate possession - they can not stop you from possessing at the park


Here is the city level

Sec. 229.001. FIREARMS ; EXPLOSIVES. (a) A municipality may not adopt regulations relating to the transfer, private ownership, keeping, transportation , licensing, or registration of firearms , ammunition, or firearm supplies.


Now Chapter 411 states where you can not take a CW
A city park is not on the list and they can not regulate it

However B6 does say that a city may regulate the following for non-CHL
(6) regulate the carrying of a firearm by a person other than a person licensed to carry a concealed handgun under Subchapter H, Chapter 411, Government Code, at a:

(A) public park;
(B) public meeting of a municipality, county, or other governmental body;
(C) political rally, parade, or official political meeting; or
(D) nonfirearms-related school, college, or professional athletic event.


Now with this said, knowing I am not a legal eagle, They can not post a 30.06 at a city or county park

The sign has no bearing. Even if it were a valid 30.06 sign they cannot post it in a city building that is not used for official city meetings. In general, city buildings cannot be restricted to CHL holders unless they fulfill specific criteria. Many cities and townships in Texas choose to overlook or ignore this and do it anyway.
The general consensus at this website when encountering such locations is to either conceal it and keep your mouth shut (which you should be doing anyway) or elect to become a test case and let them know you are carrying. You can then tell us how the ride to the jail was until you convince them that they are in the wrong.

Edit: Please don't take this as a personal attack. It is simply my take on what many of us see as the current reality of the situation.
