Newbie here, and yes I did search the subject but could only get it down to 1052 topics to pull up in the search. I am currently waiting on my paperwork to come in so I can Carry.

I dont not plan to carry in the office being we have been told not too, and it is not posted. But was planning on locking the Weapon up in my truck at work in a car safe that installed in my center console that is secure. But during the class we was told to check our employee handbooks and read what the employer is stating. my states..

Possession of a firearm on company property or in company vehicles. A license to carry a handgun does not authorize possession of a firearm on company property or in company vehicles.

Possession, display or use of firearms, explosives, knives, weapons or any other hazardous or dangerous devices on or in any company property (including parking lots, break rooms, company-provided lockers, and company vehicles) or at any company function, whether on or off premises.

I know that some states have had their laws changed to prevent Companies from doing this. Does anyone one know when and if the Texas law will get changed.

NO they do not search you cars here ,but you know I value my job here. So I dont want go under the dont ask , dont tell rule.

Please let me know your thoughts.

Texas does not have a parking lot exemption. Hoping for that next session.

Per the company guidelines you quoted, it is spelled out pretty clearly that you cannot have a firearm on company property or in the parking lot and they can fire you for doing so.

As Keith said, we can hope that there will be a law in our favor on this issue very soon. Until then, I can only tell you what I would do. My personal safety and my sheepdog instinct would compel me to have my gun in my vehicle and hope that there is never a reason for my employer to find out it is there. That said, in this day and time a job is precious, and I understand you not wanting to jeopardize yours.

What's not to understand about the employer's rules? Employees have been given notice that no guns are allowed.

As bdickens asked, "How much do you like your job?"

Since they give you notice does this in turn mean its illegal to carry? Even if you are not worried about the fired part.

I disagree. The way it is stated above that it is written into the handbook does not constitute proper 30.06 notification. It has to be word for word if written in a policy manual to be illegal. They can still terminate but not have him arrested.

Now, on the other hand, if they verbally informed you either one on one, upon being hired, or as a group at a function or meeting, then it does not have to be word for word and can be grounds for arreast.

RPBrown is correct. This in itself on written form does not constitute a legal 30.06 notification. However, if you have ORALLY (verbal can be written also) notified you, then you can be prosecuted for the violation. Otherwise, this is just fireable offense.

That is your choice as to carry or not on company property. And while the statement you made is technically correct, you CAN be arrested, but it would be a false arrest. Legally it is not prosecutable unless the manual is in the form of 30.06 or you have been told in person orally.

...technically correct, eh?

This false arrest could end up costing a lot of money and since you've already been fired, how are you planning on paying your attorney to get the arrest expunged (is that the right word)?

Does the verbal notice need to be the same verbatim as the sign. Or can they just simply say CHL holders are not allowed to carry? And who has to be the one to tell if you work in a big corporation?

Do you have the option of parking your truck close to, but not on, company property?

If you are not parked ON company property, you are not violating their policy.

Of course, if the parking lot close to company property is in a high-crime area, that's not a good idea, either.

Am I incorrect or doesn't 30.06 refer to alchohol, not general no gun announcement.
Employer can restrict and in the parking lot too. Different than law about school, hospital, etc where parking lot is ok.
Am I right or wrong here?
