Eligibility Question

#1

Post by merdock69 »

Related to "Obstruction of a Passageway (Class B Misdemeanor) in Dallas County, Texas. Received a disposition No. 1 of "NonAdjudication of guilt (Agreed plea)" AKA (Deferred Adjudication) on 6/23/2008 resulting in 18 months supervised probation and then received disposition No. 2 of "Charge Dismissed." on 12/30/09 after successful completion of the probation.

Had a CHL at the time that expired while suspended (was not revoked).

Does the 5 year clock for eligibility start on 6/23/2008 with the first disposition of Deferred Adjudiction resulting in eligibility at 6/24/2013 or does it start on 12/30/2009 with the final disposition of dismissed resulting in eligibility at 12/31/2014?

Thanks for your help.

The exclusionary period begins on the date the judge approves the deferred adjudication agreement. (This is for a Texas case.)
