I think the best approach is to forget the legal discussion and make your decision based solely on the situation and whether you feel you need to shoot. If you think their intent is to do you harm, then put them down in tactical order, or until the threat is removed.
If you don’t think they plan to do you harm, then you could order them to stop…leave the scene, get on the ground, drop their pants and stand there sucking their thumbs, or a lot of other things…just don’t pull the trigger.
If you fire when you need to, and not just because they may have represented a threat, I suspect all the legal issue will fall out in your favor in the vast majority of cases (ain’t it great living in texas!).

If they had their hands raised, and were showing that they had no intention of harming you, then I think that you could be charged with murder, especially if a witness sees you pop a couple of BGs who are surrendering.
Lord knows that the antis would be on you like pack of pitbulls on a porkchop. They would definitely turn a good shooting into murder, or worse, a hate crime murder, depending on what color the guys were.
If I were in this situation (I'd like to think) that I would just put some distance and cover between me and the BGs and keep aim on them until they were out of the area, or until the popos showed up.
