Quick clarification of school policy

#1

Post by UofHdevildog »

I attended U of H regulary but I also take a course at a community college. I'm very versed in the laws for both long guns and my CHL, but as I was reading the policy for the community college I came across the section that discusses weapons carry. It states that no weapon is allowed on campus at all. Now I already know the CHL part, but what about my shotgun that I regularly put in there during hunting season. U of H doesn't care at all because they obviously are on top of their legal powers, but I think this small school might be overstepping their boundries when it comes to carrying a long gun secured in my vehicle. Can someone take a minute and help me out? I know I should call them but after dealing with the PD before there I can promise I'd be reported as a threat for asking a simple question!

Here's the policy (pg. 47) http://www.lonestar.edu/departments/adv ... onduct.pdf" onclick="window.open(this.href);return false;

And I'm glad I came across this site!

Welcome to the forum.

A school can make any policy that is not explicitly illegal (for example, they can't ban colored people). They can discipline you for violating their policy. Their policy is not law.

That said, if you get crosswise with the campus police, they can arrest you and let you deal with the consequences. People are arrested for doing nothing illegal all the time.

Your best bet is to keep whatever in a locked box in your trunk and not talk about it.

IANAL, etc.

This is from the U of H student handbook. My kids went to U of H and I know at that time NO guns were allowed on campus. My son had his CHL and he was told by a Dean that if he were stopped on campus in his car by the campus police, he would be required to produce his CHL with his drivers licence (if carrying). The Police Office would not arrest him, but would fill out a "student violation" against him for having a gun on campus. That would be an automatic expulsion from the school with no chance of re-admittance.

"The following acts are defined by the university to be unacceptable.
Being under the influence of drugs and/or alcohol
does not diminish or excuse a violation of the Disciplinary
Code. The list may not be all inclusive:

3.13 Possession of Dangerous Weapons-Unauthorized
possession of a firearm, weapon, dangerous chemicals,
or any explosive device of any description (including
compressed-air guns, pellet guns, BB guns, shotguns,
or illegal knives) or the ammunition of any firearm
or other dangerous weapon or explosive device on
University grounds. (A weapon in your vehicle constitutes
possession.)"

You need to have the term "unauthorized" defined by the campus police. It also says "university grounds." Have them define that too.

Keep it hidden and don't consent to a search.

Only for K-12. Doesn't apply to post-secondary schools.
