There is a damage minimum after which a report must be filed. IIRC it's $1k, but I'm not sure about that.

Unless it's a fence used for the production (I don't want to think about how that works  ) or containment of livestock, then it goes straight to felony. Good reason to keep a shetland pony in the passenger seat. :evil2:

I've had two similar incidents lately. One, a guy comes flying up behind me on the freeway changing into my lane when he realizes there's no way he's getting past a whole line of traffic. He's literally inches behind me. My tactic for tailgaters is to ease off the gas, which usually sends the tailgater onto his next victim quick. Only in this case, it gave him an opening to do exactly what I didn't want him to do. It opened up a tiny slot for him to change lanes, pass me by inches, and cut back in front of me. I seriously thought he was going to hit me changing back into my lane.

That wasn't bad enough? No, then with less than two feet clearance, he slams on his brakes after only a fraction of a second of being in front of me, and hits me! I guess he taught me a less or two huh? I think that shut off my fuel pump and killed my engine. We both started to exit the freeway, and I worried I was going to have to deal with this idiot on the side of the road. By the time I limped to the access road, he took off. Fortunately, I had only trivial damage. I hope at least it left a good mark on his BMW!

Second one, I'm on what is usually a deserted two lane black top. Quite unusually, there's an oncoming car, and a lady pulls up to a stop sign at an intersecting residential street. She gets tied up paying attention to the oncoming car, much farther away than me, then turns left almost directly in front of me. She pulls out right in front of me going 45, and two seconds later, as usual, there wouldn't have been a soul in either direction for miles. She's going to kill herself in a broadside accident just a block from her house to save herself two seconds! Fortunately, I predicted what the idiot was about to do and was able to slam on my brakes just in time to keep from hitting her.

I see the same sort of idiot drivers in the Dallas area too. The tail-gaters going 90 irk me to no end. If everyone would relax and drive courteously, there wouldn't be as many rush hour accidents, and traffic wouldn't get so backed up. My other pet peeve is people that are driving in an "exit only" lane (because there are less cars) and they accelerate all the way to the last minute, and then slam on their brakes and try to merge back into regular traffic, holding up everyone else that wants to exit.

yes and no. There is no set amount of monetary damages that require a police report, but if the damage is such that the car cannot be normally and safely driven, it must be reported to the police. This is in Transportation Code section 550.026.

In sections 550.021, 550.022, and 550.023 are your required duties to share information with the other driver and provide him with medical attention if necessary.

Well, since this thread has already strayed off course, this happened to me a couple of years ago in Houston.
Going East on 1960 in the inside lane, a guy in the next right lane cuts over in front of me just a few feet from my front bumper and hits his brakes hard. I had to hit my brakes hard, then I hear tires squealing behind me. I look in my mirror and see a patrol car is sliding toward me. The officer got stopped two feet from my bumper at the most.
The guy that cut in front of me turned left and I saw in my rear view the officer turn left and turn on his overhead lights.
There is some justice in this world after all.
God Bless America, and please hurry.

This is actually what got my wife and I off our butts and into the CHL class. She was driving to work a couple of years ago, slowing down for a red light, when a guy rammed into the back of her car. Thinking she had just been in an accident, she pulled over and he rammed into the back of her car again. He then slowly drove down the left side of her car, creasing it from wheel to wheel with his running boards. Once in front of her, he calmly stopped behind the car in front of him and waited for the light to turn green.

She followed after the light turned green and called 911. The operator told her to pull over and wait for the police, which she did. That pretty much just guaranties nothing will happen to the perpetrator. Long story short nothing did happen to the guy in legal terms. My wife was freaked out because she did nothing to provoke this attack and the guy lives within a couple of miles of our house, we still cross paths occasionally on the roadway.

It was kind of a blessing is disguise since we went from no guns to several guns and even shoot semi-competitively a couple of times a month.

I'm somewhat perturbed by the stories recounted here. Is there no offence of "Leaving the scene of an accident" in TX law, or is the reality that there is one, but nobody cares to enforce it?

I thought about ramming a guy on my way home from Houston tonight. He was one of those drivers that love to hang out in the left lane just behind your bumper. I couldn't shake this guy no matter what I did. I would slow down... he would slow down, I would go fast, he would go fast. Four hours this guy hung onto me like he thought I had a radar detector or something. I thought about ramming him but was afraid he might be on this forum and I would be embarrassed if he told everyone I rammed his truck.

Four hours??? Wow, couldn't you have taken a bathroom break? Would he have followed (tailgated) you into the men's room?

Better still, I'll let you work out the details of how handy a rusted out spot in the floorboard can be for dealing with tailgaters...especially at bathroom break time.

Of course, there's always the solution of getting out of the passing lane when you're not passing.
