I lived in New Orleans for 30yrs. There was corruption at every level of government. It was never a question of if a palm was going to get greased it was simply a matter of how greasey it was going to get. The cops were no exception. You couldn't get anyone to testify against a thug because if you talked you died. Turned out the death squad was several LEOs. Don't know if she was ever executed or not but there was a female LEO convicted of killing her partner because he found out she was on the take.

I could go on and on but you get the point.

Did anyone read the comments at the bottom of the page with the video? Other people have had similar treatment from the Carrollton PD. This is just the tip of the iceberg. Kudos for this guy with the lawsuit. Although the guy did wrong by getting out of his car, the officers were way out of line for threatening him when he went to get the video evidence. That's why I always have a hidden cam in my car during traffic stops just in case they "lose" the squad car video. I have had a situation with Austin PD before where they LIED about me running a red light, but I got off the ticket because I had video rolling whenever I drive. Cops are just like regular folks. Some are bad and some are good. A hidden button cam costs less than $20 on ebay. It is a false shirt button that is really a videocam. Get one. It will pay for itself some day.

Major snip, so I can respond just to this one point:

Before he got out of the car, it was a reasonably low-key approach by the police. Not in their minds, of course, because they suspected they were dealing with criminals. But the dealer could have easily thought they were in conversation mode, not "freeze, suckah!" mode. If that was his mindset, he might have thought it was perfectly reasonable to step out and explain what was going on. After all, he knew he wasn't doing anything wrong, so he probably thought he could just explain what they were doing and everything would be okay.

I think he just got his first understanding of why we recommend treating even a minor traffic stop as if the cop suspects you're armed and dangerous and wanted for murder.

And the City of Carrollton is going to get a monetary understanding of why it's cops should treat all citizens in a stop with respect and dignity, and exercise a little common sense.

handog, any update from Round Rock on your OP?
Since there was little or no enthusiasm coming from the NRA or any lawyer I spoke to I decided not to file a formal complaint. I also took into account the feedback I received from this forum. I did however email the sergeant suggesting the officers involved review CHL law. I have since learned that I have the right to view the police report and hear the 911 tape. I have been busy making a living and have not pursued them at this point.

I am new to this forum and was really surprised to learn that being arrested for printing was rare since it happened to me so easily. If it happened to me, it can happen to anyone. I can tell you that if you have never been to jail it is extremely unpleasant. I'll wait two years then have it removed from record. It’s one more example to the members of this forum that even though you may be in the right, and beat the rap, you may not beat the ride

Wow!

I hope any and all officers and persons in charge who were involved in violating this mans rights are prosecuted to the fullest extent of the law.

Just talked with a rep from CHLPP services asking about their legal services. He was telling me about the Carrollton matter and asked me if I knew the updates. I said no. He told me that there are now police cars parked outside his house day and night. He complained to the police dept but they said it wasn't happening. He called the news crew and cameras showed them outside home. Said he was written a ticket as he pulled out of his drive on one occasion. He told me some other interesting things too that do not seem to be established yet, so not saying for now. But if it is so, is truly unbelievable.

FWIW, I left with a favorable view of the CHLPP legal services after I quizzed them on several things not listed on their sight.

So many things done wrong, by both of them.
I teach in my classes, as we were taught by the DPS.
STAY IN THE CAR,
Hands on dash.
Wait for the officer to approach.
Declare yourself as a CHL holder and ask for instructions.
Follow those instructions.

He exited the car after he was told STAY IN THE CAR.
The declaration AFTER he exited the car against instructions, was to declare the gun - I would have seen that as a threat too.

The only crime committed was the PD threatening him when he went to pick up records. That should get several PD employees fired.

And as always this is JMHO.

The outcome of this will take years. The strongest evidence is the video and it has some gaps. I read his lawsuit and the responses. He was arrested when he went to the police station according to the suit.
