I am not a lawyer, but I don't think it's theft when you refuse to pay for something you never received. When you go to a Hooters, a large part of what you are buying is the ambience. I would have told the manager that I was perfectly willing to leave, but I was not comfortable paying for something that I had not received. If he insisted on me paying, it would have been via credit card, with the words "under duress and threat of arrest" next to my signature. I would then have disputed the charge with the credit card company. Also, refuse any "to go" food since that is not what I ordered.
I realize that this is probably all of $20 at most, but it's the principle of the matter.
