This comes up from time to time...

I would not be surprised, that how long this has been going on, that the corporate types may someday remedy this issue and instruct their franchises to properly post their restaurants sometime in the future...

But then again, considering how much they actually listen to their customers about anything unrelated to food in the first place...It may not happen...

Taco Cabana, I could learn to leave it if I had too...

They had me recently hooked on their Fajita Chicken Papusas's with that Chipoltle Pineapple Salsa that was to die for...

But then "Wife-Unit" and I figured out how to make our own...Salsa and all!!! Woo Hoo!!!

Take that TC!!!

If I see a sign that is not correct I carry, It has no effect on me or my ability to carry on the premise.
A no weapon's sign that's not 30.06 compliant doesn't make me mad, that sign is meant for someone who doesn't have a license.

I would NEVER explain to management how to put up the correct sign to prevent me and other CHL's from carrying.

The signs that are up at Taco Cabana are not compliant, therefore, not binding...

A letter telling them how to put up a binding sign could be disastrous for our community if they so decide to obey the letter of the law.

As ElGato said:

And, as was previously posted by another poster (can't find the quote as I'm writing this; so I'll paraphrase) "Taco Cabana is a large chain. Taco Cabana has many lawyers working for it."

In My Humble Opinion: It stands for reason that if Taco Cabana really wishes to ban weapons from their establishments that they would post fully compliant signs, doesn't it? Could be that their intent is the same as the employee manuals that mention firearms but don't use 30.06 language. They might fire ya, but they can't send ya to jail.

Or their intent is to simply 'pacify' the anti-gun crowd, aka: liberals, and to keep them happy while all the time they know the sign isn't binding.

Remember: "You can't convict if the glove don't fit."

Same reasoning: "You can't convict if the sign isn't compliant."

Makes for some thought doesn't it?

The only problem is that they never proved the glove didn't fit.

I called DPS, the AG's office, and everyone I could think of a couple of years ago, trying to determine if there was any way to "ensure" compliance in posting. The eventual response that I got, from a young lady in the CHL department, was that they considered any sign a reasonable effort and therefore expected compliance. She got miffed at me when I suggested that the same logic might apply to speed limits. She suggested that I might volunteer to be a test case. Made me glad i didn't give my real name.

Even though LEOs here and elsewhere have said that they would not enforce a non-compliant sign but would suggest that a CHL leave and consider not returning when carrying, they may not be the officer that confronts you and you may spend some time and money straightening out the confusion.

I had to go check out our local TC after this discussion. The one in SE Houston on Bay Area Blvd has the "unlicensed carry prohibited" as they should with no 30-06 sign. I also got a chance to look at their liqueur license and it had the "SIGN=BLUE" statement which means they're not in the 51% club (see other thread in this forum)

There is a thread on GlockTalk here that quotes a response from some Taco Cabana bigwig that states their policy is to comply with Texas law to effectively ban CCW to "protect" their customers. Interesting read.
Remember, in a life-or-death situation, when seconds count, the police are only minutes away.

The sign is actually a 30-06 sign, although close to the register (and 10-15 feet from the door). I saw nothing in the law that said it had to be on the door, just in a conspicuous place. The main question I have was to the size of they letters. They may or may not be 1", but I had no way of measuring. Additionally, if that is the way TC corporate wants it, I will simply take my business elsewhere.

A friend of mine who pointed the out the signs to me at Taco Cabana did send them a letter and he did receive a letter back. I would post it but not until I get his permission. The corporate para-legal gave the reason that the corporate reasoning was that banning all guns was the safest route for their customers. They realized that this desision would not be popular but they hoped that he would remain a customer. He replied that he would choose not frequent their stores.

I am going to take the time to write a letter to Taco Cabana letting them know that they no longer have my business. I am also going to explain to them how flawed their thinking is, and cite incidents such as the Luby's shooting in Killeen and others to illustrate my point. I think as many people who feel comfortable doing so, should do the same. Once the texas3006.com site is up, it will make it much easier to do the same with other businesses and coordinate our efforts.
