What is law V.C.S. Art. 4413 (29ee)

#1

Post by bobv »

I was in Salado recently and on an older building with a sale going on inside I saw a large sign posted by the door that read:
"Possession of a Handgun Under Authority of Texas Concealed Handgun Permit Law [V.C.S. Art. 4413 (29ee)] Is Prohibited On These Premises."
Does anybody know what this is?

I believe that is a rather ancient sign and has been superseded by 30.06.

I would carry past that sign unless it was a place that was prohibited for some other reason. IANAL. This is not legal advice. YMMV.

If a hospital is posting the V.C.S. Article 4413 (29ee) signage, does this affect me carrying as a CHL holder?

The V.C.S. (Vernon Civil Statutes) Article 4413 (29ee) refers to the entire Texas Penal Code section pertaining to CHL holders. As of 09/01/1997, the amended laws require the correct posting of the 30.06 statute in order to prohibit CHL holders from carrying in locations that are not otherwise prohibited by law or by other permitted posting (ie. the red 51% signage issued by TABC).

In short, the old V.C.S. posting alone does not prohibit you from carrying on these pemises.
I am not a lawyer. This is NOT legal advice.!

What it is is obsolete.

And please keep quiet about it.

Fortunately, I don't possess my handgun under authority of Texas Concealed Handgun Permit Law [V.C.S. Art. 4413 (29ee)]. My license to carry a concealed handgun is under authority of Chapter 411, Subchapter H of the government code. So, I just walk right on by and remember that concealed means concealed. That sign is simply an old sign that was effective at one time, but has now been superceded by 30.06 notices. I still see them spread around town occasionally. My work is even posted with one...

There is one at my dentist office and so I called the owner of the building and let him know the sign wasn't valid and I carried there anyway and his tenants wouldn't see another dime from me.

Then I went to the local sign ship and had them make up a proper 30.06 and delivered it to him personally and told him how to mount it. And then I said haha dummy. Showed him. Yup, that is what I did.
