This is the response I received:

Although you returned your application after September 1st, you initially applied for your renewal online 8/2/05, so you would not be eligible for a 5-year renewal license.

And do we think that DPS is correctly interpreting this law?

Here is HB225:

SECTION 3. Section 411.183(b), Government Code, is amended
to read as follows:
(b) A renewed license expires on the license holder's
birthdate, five [four] years after the date of the expiration of the
previous license.
SECTION 4. Section 411.173(a-1), Government Code, is
repealed.
SECTION 5. This Act applies only to a license renewed on or
after September 1, 2005.
SECTION 6. This Act takes effect September 1, 2005.

It would seem to me under Section 5, I would have recieved a 5 year license.

You know when mine expires in latter half of 2009, the number of RENEWAL classes being offered will be near zero, since most folks would have RENEWED early 2009, or gotten the 1 year extension.

I bet many folks toss their old license when the new one arrives, and thus are not carrying a valid license until their Bday.

You don't have to keep the old one; the new one is good from the time you receive it; but it didn't add any additional time to your lawful carry duration. Thus, it still qualifies for a NICS exemption.

Also, as you already know, the date you reapply is not controlling; it's the "official" renewal date; i.e. your expiration date.

See this is why I have to wonder why they have to bust our bowling balls over the date that you renew...

Of course I can see why if you put in your package, and they completely process and mail off the card before Sept 1st...

But in the original case it appears it "straddled" the date the 5 years was to take effect...It's no more or less money to the State in relation to the "fee" we have to pay for this thing...

I feel sorry for the folks renewing over this particular period of time, but the State sure should allow someone to appeal the timeframe of the license...Like I said, it can't be about the revenue generated from the fees...

But all this should soon pass into obscurity...Seems like they got away again with screwing around with our sensibilities...

It is not that big of a deal. The annoying part is I read the law, and intentionally waited till after 09/01 to submit my application, just to be safe, even though as Charles points out, I should have been able to submit BEFORE 09/01 and still get 5 years.

Note DPS has chosen to make it hard on themselves with this policy. Had they just went with after 09/01 all licenses are 5 years, they are done working. Their current policy requires them to go back and check each application and find out when the payment was made to determine 4 or 5 year, and they need to do this for another year or so, since people may delay sending in their RENEWALs. Stupid.

FWIW, I am not going to pursue this with DPS. Not worth the hassle, and there are so few folks like myself (basically a 3 month window and only CC payers), nobody will really care. I have a CHL, it is good for 4 more years...

The way I see it when you applied, you were pending renewal, it wasn't renewed until all the i's were dotted and t's were crossed and it was reissued.

I'm with you on this particular point...4 years is what we all have been used to...

Instead of the CHL office understanding why you submitted the package for your renewal, the way you did, when you did...

They went out of their way to "parse" policy, and the law, and screw you and others out of another 12 month period on your license...

I understand why you're letting this go...And I would probably do the same thing...

I hope all of this gets ironed out by 4/07 when I start to get my next renewal going...

interesting, but I wanted to add I got my chl back on Sept 12th, I sent in the packet on july 19, the pin # was postmarked on aug 8, and on top of that my license expires on april 2010. so thats 4yrs 7 mo. correct? This was my initial app.

with that said I think the DPS did screw up on your exp. date, and I think mine too.

Your license is correct Night4creeper, the first issue is for 4years and too your next Birthday.
