Yeah I agree with what you did as well. Good work. I hope your actions will not only resonate with that guy but also his friends (and their friends and their friends) as he goes around telling his story, which I hope he does. People need to understand that folks (esp. in Texas) ARE ARMED and they won't stand for foolish behavior such as this. You cannot go around bullying everyone or you will eventually end up shot (even if your intentions were not to harm - for example, asleep could have thought he saw a gun and fired. game over.)
I only wish we had some law/judicial type of folks on this forum who could chime in and give an ultimatum on this type of story, just so we could get a glimpse of how it would really have played out in court (certainly not to get anyone here in trouble but just for confirmation on our thought processes).

As did the LEO.LedJedi wrote:IANAL, but given the scenario you describe I believe you were justified in drawing.

I agree with asleepatthereel actions. I ride and would have done the same. I have ran from an aggressor one time and that was cause I didn’t have a firearm of my own and I wasn’t going to just roll over and play dead. I will admit I got lucky and those of you who have read the story of that encounter would agree. The person in the car initiated the attack when he used his car to force asleepatthereel to stop. When a car is used to make a bike stop I will consider that an aggressive action with deadly intent.
I do not know the orientation of the car and bike when both persons stopped but if I have it right in my head it might have been more dangerous for asleepatthereel to try to escape around him. To many other variables come into play that would not have turned out good for asleepatthereel.
There is another rider on this forum that had an encounter with a person suffering from road rage and domestic argument at the same time. All this rider did was pull up next to him and look around as most people do. I guess the guy in the car didn’t like it. long story short a fight ensued and the biker got a broken collar bone. Even though he had all his riding gear he slipped on some debris on the road and the driver fell over on top him. His shoulder landed on the curb at the wrong angle. Hes fine now and waiting on his CHL to come in. I belive he would have be justified in doing the same as asleepatthereel did in this encounter.

Who knows what his intentions were, but I'll bet he thinks twice before doing it again.
Re: I had to draw last week. Looking for input
lets hope he thinks twice next time and not go out and get a gun and just shoots some one...sounds to me like he is the type of person that would do that.

All you who are second-guessing the OP for not driving off need to realize that in the matchup of car vs. motorcycle, car wins every time.

Are you willing to risk your LIFE in waiting to find out what his intentions really are?SCone wrote:Who knows what his intentions were, but I'll bet he thinks twice before doing it again.
His actions leading up to the drawing of said weapon...pretty much summed it up, doncha think?
Most motorcycles power/weight ratio allow them to out accelerate most cars in a straight line...but if you have to add swerving to avoid having 3.5k lbs of steel parked on your chest...4 wheels win against 2, a 800lb bike vs 3,500lb car is no contest..I know...I got hit by a car going 15 and it sent me right to the concrete face 1st, no control, imagine if I was running, going 70+ trying to escape...then got clipped.

Another thing you might want to start doing is building up a habit of noticing license plates. Every time you see a car, read the plate to yourself before you look for other details. It will become second nature, and you'll have a pretty good chance of being able to give a partial plate even if the situation distracts you like this one.
Of course, it can get a bit too ingrained; sometimes I'll notice plate number, but not color, make/model/year, etc. You might also look into a cheap digital camcorder and a mount for your bike; it can get some really cool videos anyway, and with audio recording too, it can be a pretty good witness in a situation like this.

I truly commend you, I think you acting accordingly to the situation you had in front of you.
My only hope is I can act as Kewl' as you did, If the occasion ever arose for me to draw.
Thanks for your addition to the forum.
