The cops will try to get you to go away on this one. They figure insurance will handle it. This kind of stuff doesn't rise to the occasion for them. I am surprised they even came out. probably showed up to keep you from creating a disturbance more than to nab her for hit and run.

I thought they would see it as a road rage incident and escalate charges to the point where it would interest them.

No witnesses. His word against hers. She is already trying to claim he caused the accident. If nobody is hospitalized or killed, they move on to more pressing issues. Dallas probably has this kind of thing many times a day. There aren't enough cops on the force to chase down stuff like that. It stinks because if your the person being victimized it is a big deal, but they just don't have resources to deal with every case of alleged road rage or hit and run that comes along. It has happened to my fleet more times than I can count and it always ends up with my insurance covering it. I have no idea if my insurance ever recovers from the miscreants that act innocent. It goes down as a no fault of mine accident, so my insurance doesn't get tagged. Individually that is... all of us pay higher premiums for this kind of non-sense.

I work in that area, also. I have gotten a couple of alarm calls in the middle of the night. That's always a fun trip. I am amazed how much traffic there is between 2 and 4am there. One of our security guys was working on the alarm, he was parked in the front parking lot, out of sight of the office windows. Someone broke into his pickup and stole some tools.

Yep, lovely part of town!

Yeah, that's two things I've also learned from this website that was NOT taught in my CHL class;
1. dial 911 FIRST
2. de-escalate
3. be aware of your surroundings

At least they are nailing her with something. Many times they do nothing at all.

This is actually a good result. First, it makes the damages her fault beyond any shadow of a doubt and keeps the "accident" off your driving record. If they took an accident report at first, which is normal, you can get the offense report to have DPS remove it from your record. Second, the penalty for criminal mischief is based on the amount of damage. It is not too hard to get $1500 worth of damage in a car these days, and that makes it a felony charge. leaving the scene of an accident without injuries is only a misdemeanor.

So, clear driving record for you and felony charge for her. Yep, I count that as a win for you.

Is there any requirement to report a collision with no injuries? If the parties exchange information and choose to drop the matter, have they fulfilled their legal obligations?
