Carrying while travelling for work

I work for the State of Texas, specifically TDCJ. TDCJ policy prohibits its employees from carrying a weapon in a state vehicle or in a personal vehicle when used on state business.

As I travel all over the state and am concerned about my safety, what, if anything, could I do to have this policy changed to allow CHL permit-holders to carry?

Please do not suggest I get myself killed in a mugging while travelling and have my family sue the State of Texas. ;-)

Is a governmental agency allowed to make that policy? Charles/TXInvestigator?

Otherwise, I would contact my rep/senator and go to town. I doubt anything else will work.

Unfortunately, yes a state agency can have that as an employment policy.

The agency that employees you can authorize you to carry a gun while traveling, but I have no idea what your chances are of getting this approved. It would probably be more likely that they would allow it in your personal vehicle, than a state vehicle.

Failing that, a call to your State Rep. or Senator may help, then again it may not. I wish I had better advice.

Any employer has the right to prevent you from carrying in a company owned vehicle, regardless of whether you have a CHL or not. I doubt you could be arrested for it, but you can certainly be fired.

Some companies think they might be held liable if CHL holders carry in company cars and then go all "Xerox" and start shooting their co-workers. Oh wait - XEROX IS ONE of those companies!!

Even in your private vehicle, if it's compensable (you're on the clock and/or being reimbursed mileage, making it "official travel"), then they can set all sorts of restrictions, including not possessing a firearm or not drinking alcohol.

Then again, it's TDC... getting fired could be the best thing to ever happen to you! :grin:
