CHL not recognized by bank as valid ID?

#1

Post by Glocktex »

I went into my local bank yesterday (Chase) that I am in almost every week to deposit my paycheck. Well I needed to cash part of my check for my sons daycare and deposit the rest. The clerk points out my DL is expired by a few weeks which I was not aware of and could not give my any cash back. She could only deposit my check.

I have never presented my CHL to anyone. I was VERY reluctant and hated to do it but I needed to pay daycare. I figure it is issued by the State, has my picure, and State Seal so I hand it over. They look at it a while and then tell me they cannot accept it as ID.

Hopefully this will help prevent someone else from presenting it as ID at the bank. I know I do not like anyone to know I am licensed and hate the fact it accomplished absolutely nothing.

You need a new bank.

I have been able to write myself a check and cash it at every bank where I have had an account.

You might consider a credit union. They pay better interest and are friendlier for the most part. The are insured the same as banks.

I am pretty sure the CHL is a valid form of ID per the state guidelines. However, any private business can decide that they don't want to accept it, just as they wouldn't take an expired drivers license.

I can't understand the expired DL not being accepted; all they are looking for is something that shows your name and picture. I have had places accept my company ID as a valid form of ID, and I am sure that IT is not a legal on defined by the state. I have also seen people use a credit card with their photo or a Sam's club card as a second form of ID at places. LOL

Correct me if I am wrong but your CHL is worthless unless it is acompanied by a valid DL. Since your DL expired it is not valid.

Never thought of that. Anyone know the answer to this?

FYI- I just went online and renewed it. It allows you to print the page to use as a temporary ID for 45 days.

I think it depends on what you are trying to do. A valid ID can defined as many things. A good example is that TABC rules don't define what a valid ID is. Also, I know of no law that states a bank can only accept a current drivers license as a valid ID. it may be their private business rules, but not law. If they write in their rules that a valid ID is a piece of paper with your name and Mickey Mouse's picture on it, then that is their form of valid ID. That would also include the CHL.

PC §46.15(b)(6) makes 46.02 inapplicable to a CHL holder. If you want to walk, ride your bicycle, your mule, etc., you need only the CHL, not a driver license.

GC §411.205 requires a CHL holder to display his driver license or other state ID and CHL when asked for identification by a LEO. However, it is not a criminal offense the first time if you do not comply.

There is also a constitutional question of whether you have to display ID to a LEO at all when you are not engaged in a licensed activity such as driving or hunting. This question has not been tried in court in Texas, as far as I know.

That said, I always carry ID on the principle that complying with the request of a LEO is a lot less painful than dealing with the consequences of not complying.

As for expired driver licenses, this isn't the Soviet Union. If your DL is a few weeks overdue and you're not doing something outrageous like driving drunk, most cops will give you a warning. Even if they write a ticket, the judge will dismiss your case if you have a valid DL by the time of your hearing.

And to add, here are the rules for selling tobacco products in Texas. http://www.window.state.tx.us/taxinfo/t ... 6_1079.pdf" onclick="window.open(this.href);return false;

Notice it is stated: • other ID cards issued by a state or the federal government that display the person’s photo, name, address, date of birth, physical description and signature.

This would include a CHL.

+1 on that! I haven't had an account at Chase for years. I think their aversion to customer service and 'ease of use' of their banks has gotten more systemic over time.

My credit union, on the other hand? No complaints. Always friendly & helpful.

Go to another branch. I always do when something petty pops-up like that. Never had to go to more than one more branch to do whatever business I wanted to do (Chase).

Before you set up an account at another bank you are going to have to get a new DL.

Considering that I've used a Sam's card and my check card as a picture ID before, that's ridiculous, just because your driver's license is a few days expired, doesn't change your identity. You don't need a license to bank, just drive. As much of a pain as it would be, I would change banks when you renew the license.

I've actually been asked before when a 2nd form of ID was required, if I had a CHL as that was the "next best thing." State issued, has a photo and would be much harder to forge than some other commonly accepted ID's.

When they won't give me cash back from a check deposit I go outside and use the ATM.

If you banked with Bank of America, you don't even need a Social Security Number to get a loan there!!!! :rolll

I would be changing banks and going with a local bank. The big national ones suck.

My bank, Wells Fargo, just has my run my ATM card thru their little machine when I stop at a tellar window anyway. Much easier as it pulls the accounts up on their screen rather than typing it in.
