Gun possesion question need help.

#1

Post by Isimanica »

Well I have a friend who had her home busted into recently. So she wants to get a pistol or shotgun for home defense should it happen while she is there. My question is I believe that her son might have a "white-collar" felony. Can she legally have a gun of any sort in her home if he is going to be staying there for a period of 6 months? Also I was reading I think about possession was illegal but what is that definition really mean in real world language? Thank you for any and all help you might be able to provide. If I get more details from her I will let ya'll know.

There is one class of felony that is exempt from the firearm ban (securities fraud, I think). But that only applies to the felon, not the house he lives in. So long as it's secured in a way that he can't access it (i.e., his mom has the combination or keys), they're both good. At any time he can have unfettered access to the gun ("constructive possession", even if he doesn't actually touch it), he's in violation.

ah ha constructive is what they mean. Ok so my next question what would be a good small safe that would allow her easy access for a pistol and at the same time prevent him access too? I would also be interested in something for my self when I eventually have kids.

I bought a Stack-On electronic combination drawer safe from Dick's last month for <$50. Couldn't find a picture online, but it's big enough for a pistol, and has easy access.

I thought I had read that felons could have a weapon for home defense only? Not all felons but the nonviolent ones.

See federal law trumps that. So from what I have read in my CHL book, the state under certain rules and time limit will look the other way the feds won't and because of 18 USC Section 922 (g) states that it is unlawful for possesion and purchasing of firearms by them. If I have I am correct this came around during the brady era as an addition. Not 100 percent sure but it makes sense since each state has different rules and regulations about felons it seems.
