Student Loans/Class C ?'s
Finally applied for my CHL, have the class this Saturday.
While applying on the DPS website, it asked if I had an student loans that were in default.
THIS WAS SUPPOSE TO BE TAKEN OUT BACK IN SEPTEMBER.
I had loans that defaulted, not sure if their cover by chapter (57?). I paid ALL OF THEM OFF back in June, but I was worried about it not showing up, so I waited, then I found out that it was to be dropped as of September. The website still had it on there, so I just waited, I know how messed up things can get when it comes to the DPS, and the 140.00 fee is NOT refundable. I wound up waiting so long it became an X-mas gift.
It is now January and the DPS application page still ask if you are in default, I selected no, since that is no longer suppose to be a factor.
Also, I had some Class C misdemeanor's that turned into warrants, then arrested. 2 of the 3 I have paid for and taken care of in court. The third is from Ft. Worth, I pled not guilty for it, and I've been waiting almost a year now to receive a court date (offense date was in 2004) after being arrested, and I pled not guilty and mailed it off back in '04 when I got the ticket, and also never received a date.
Also on the online application part, I selected no arrests, because I thought Class C's didn't count. From what I've read on here they do no disqualify you, but you must send something in along with the packet, which I have not yet received. What do I need to send in.

If the printout they send from the online application is incorrect, I thought it was kosher to correct it by hand.

There from Grapevine, Euless, and Fort Worth for the one I'm still going to court for.

Welcome to the forum Sewer_Ice.
There will be people along soon who can answer your questions but I will tell you
that you will need to obtain a disposition letter of each arrest from the county clerks office
in the county that the arrests took place.
They will need to be certified copies.
You will need to send those in with your application and make copies for your own records.

I had some class C's as well. I applied online. And really fretted over how to handle everything. But with the excellent help I received on this forum all went well.
USA1 is correct. You need certified copies of the "disposition" of the court cases against you. In Tarrant County they are called "Final Sentence and Judgment. And they are $6.00 each if memory serves me correctly. (I had 3 of them).
You will need to go to the Criminal Court District Clerk to get those certified copies. I'd call before you go though, is my suggestion and visit with them. They can tell you how many cases they have or had on you, and what you need to do. You'll need to go to the:
Justice Center
401 W. Belknap
Ft.Worth, TX 76196
Tel: 817-884-1342

I did these 2 things after I took the CHL class. It took about 4 or 5 business days to get them. (in looking back, I really can't say for sure if it helped, but it made me feel better).
I sent all of that stuff with my application packet back to DPS. I believe it took 48 days from the time I went from "processing application" to "application complete. license issued or active") Be sure and keep a copy of EVERY piece of paper you send them! (in case there needs to be a follow up)

You will receive an application packet from DPS. It will contain 5 pages of basically what you filled out online. You DO need to correct ANY incorrect information that you find on the form(I had an address correction). And that includes P.3(Criminal History). You'll need to provide a full disclosure explanation of each and every offense. There wasn't enough space for me to explain everything I had in the space provided, so I simply hand wrote in the space "See Attachment A". I then typed out a detailed explanation of each offense and the disposition of them. It turned into 2 typewritten pages in landscape format. I only have 2 questions left. I am still waiting on Ft. Worth to give me a court date, can I still get a "Final Sentence and Judgment" The stop was for a "illegal U-turn" The fine is 140.00 and that was what my posted bail amount was, so I could just plea guilty and have no further out-of-pocket, but I could get my damn 140 back for a ticket that should have never been issued.
My student loans section. I will correct it on the DPS packet once I receive it, then should I attach a printout of the new law that no longer makes that a factor, along with something from FAFSA saying I paid it? I'm really not even sure if my federal student loans are covered by that, but either way it should no longer matter.
Just if your wondering what the Ticket was for, it was from 2004 when there was a race @ Texas motor speedway, I exited 114 to get home (back from college @ OSU), and it turned out I couldn't head east after the exit, so I head to go west till I can make a U-turn. After 20 minutes of being stuck in traffic, I asked an officer standing in the median when I could turn around (traffic was stopped). He told me 1/4 mile, when the median ended. Median ended in 1/4 miles and cars were making U-turns in front of me. Myself (being the first) and 5 cars behind me were all flagged down and pulled over, and issued tickets. I explained this to her, she didn't care, she even said my tire made contact with the grass! Mailed it off with a not guilty plea, never received a court date.

Phew. I'm no lawyer to be sure so take this with a grain of salt please. Since you have not gone to court on the U-turn, you do not have a "Final Sentence and Judgment", as the judge has not ruled on your case. I assume the case is still pending. I really don't know how to give you a better answer. Sorry.I am still waiting on Ft. Honestly, if it were me, I'd call down to DPS CHL division and talk to a technician who could better answer that question.
And I have no idea on how to address the student loan issue. None what so ever. Other than to call down to DPS and talk to them about it. Sorry again.
The tickets I got were back in 2004 as well, but all non moving violations(expired inspection, registration, and broken tail light). The offense occurred in Euless, but was arrested in Arlington. And, I had some things wayyyy back in 1980 for 3 bounced checks(warrants issued but restitution made immediately, so no booking, fingerprinting, photographing, etc). That's what I went down to Tarrant County Justice Center for, to get those dispositions.
I'm sure someone more knowledgeable than I, will come along tomorrow hopefully and give you better answers.

A U-turn from 2004? Yeah, I'd insist on a court date. Chances are, if that officer even still works for that PD, she won't be available for court, and even if she is, she won't be able to accurately testify from memory. I am taking my class on feb 6th . I am currently paying on student loan that is in default and I saw this on their also. I would like to know how to answer this question as well.

Regarding the dispositions for each offense, can those be ordered over the phone or do i have to go to the actual court? For example, i got a pedestrian in roadway a while back (2003) in Austin and got it deferred. Now i work full time monday-friday so its hard to make a day trip to Austin.
Also, are the dispositions required or optional? I should be receiving my application packet soon since i just applied online.
