Hello to all.
Just took my class on Saturday. I really learned alot but also have more questions than before the class. Our instuctor wet over the sign's and posting's and all that. When we got to the 51% portion He said if you don't see this sign simply ask a manager. So here I go with My wife Sunday night to Red Lobster in Greenville Texas. Looked all around the entrance no signs. Step up to be seated and asked a young man standing there If he was a manager. He said yes I am, and I asked about the 51% sign and he told me there was no need to post a sign because any resturant in Texas that has a bar, it is illeagal to conceal carry.
Question 1 Is he wrong?
Last night went down the street to Chili's same thing waitress brought the manager to my table. Ask basically the same question. He said that he didn't know how much money was made from the bar, and there was no 51% sign. That they have the sign out front. When I left went all around the building no sign's.
Question 2 can you carry there?
Thank's in advance for your answers and comment's.

Yes - unless there was 30.06 legal signageSpiderman15 wrote: ...Last night went down the street to Chili's... Ask basically the same question. ...51% sign. That they have the sign out front. When I left went all around the building no sign's.

And, your first mistake was asking the manager. They are usually the last to know if they are legal or not.
And, yes, you were legal to carry in a Red Lobster and a Chili's.
If a location in Texas sells alcohol for on-premise consumption, they should have one of two signs: Either an unlicensed possession sign like this:

or a 51% sign like this one:

There is a really good sign thread here viewtopic.php?f=53&t=34571" onclick="window.open(this.href);return false;
Bottom line, if you don't see one of the two signs, then they are not properly posted as they are legally required to be. However, you can actually go look at their liquor license which is supposed to be posted in a public location and see if it says SIGN=BLUE or SIGN=RED. if it says RED, then the location is off limits to a CHL and they should have the 51% sign posted conspicuously. If it says BLUE, then you are OK to carry there and they should have the Unlicensed possession sign posted at the entrance.
Hope that helps!
EDIT TO ADD: And, like couzin stated, if they have a legal 30.06 sign, then they are off-limits to you no matter.

Welcome to the forum Spiderman15. I understand how your instructor feels about the signs and non-compliant postings; I would "wet" them too.

I recall when I was new going to a Korean restaurant and seeing the blue sign and going out to my car to store my gun and going back in and actually reading the sign and going back to my car to get my gun again ..... it gets easier, you'll get to recognize the 3 signs, and only 3 signs, which affect us regarding restaurants, (30.06 red and blue) the link given above is great, the above posts explained it well. so I have nothing to add except Welcome

Don't ask managers and employees if you don't see a sign, they usually have no idea, but you can look at their liquor license and see if it says red or blue if you need to.
MOST restaurants are "blue" and you can carry. (I've heard of red restaurants where you can't carry, but never have actually seen one myself. I've only seen that red sign outside nightclubs, so I don't go in any place with that sign at all, I assumed it means "caution, people with impaired reasoning and logical conversational abilities may be inside" but I haven't seen one outside the Democratic headquarters.)

Plus if you ask the manager and he says you're not allowed to carry, you've just recieved effective oral §30.06 notice.RPB wrote:Spiderman15 wrote:Don't ask managers and employees if you don't see a sign, they usually have no idea, but you can look at their liquor license and see if it says red or blue if you need to.
