HOUSTON -– Police said one of the suspects who tried to hold up an ACE Cash
Express in north Houston was in the hospital Monday after a bystander opened fire.

Police said as the suspects were leaving, a man whose wife works at the store saw the
crime going down and chased after the men.
One of the suspects was struck in the arm and was expected to survive. The other
suspect got away on foot.
Police said the shooter had a Concealed Handgun License. Officers questioned him at
the scene and then gave him back his weapon.

I guess this answers the question about whether or not you can shoot at someone while they are fleeing the scene. I doubt the police would have given him back his weapon if there were any concerns about the shooting.

Don't know all the facts obviously, but from just reading the article it seems like he might have be a little aggressive....but the cop did give his gun back so maybe there is more to the story.. either way the bad guys got busted and that is good news.

I don't think it would matter to me if he had a bag full of money. I still wouldn't take the shot. Now if he was dragging a girl by the hair and I was close enough for a clean shot, or he was shooting at people as he fled - different story.

very encouraged by the fact that they returned his weapon. In fact, I was very surprised they did. I will be watching this case for any future developments.

I did see a guy get shot by a cop after an attempted robbery. I think he had a knife. The cop came into the family practice clinic asking if there was a doctor. I think my giggling irritated him.

Granted, lots of unknowns to this story. And, Would You Shoot vs Legal To Shoot ?
I think the LEO's returned his weapon because he was "legal" to shoot, and did so.
The gentleman was waiting to make sure his wife got to work safely (I think that's
cool). I think it reasonable he believed the BG's had just done a robbery and he was
in fresh pursuit (PC9.42 / 9.43). These things happen really fast, and I won't second
guess the CHL's actions. I'm glad he and his wife (and other employees) were not harmed.
This whole robbery scene could have turned bad real quick. Good on Mr CHL.

The video said they were armed, dressed in black and wearing bandana over their faces, so "empty-handed" was with respect to not getting any cash, I don't think it meant that they were unarmed or not a threat.

Another thing to bring up was the CHL holder at risk of any harm had he just let them run off? True you can shoot a fleeing dangerous felon in many cases with supporting case law, but is it always the right thing to do? Each must decide that for themselves.
